y <br /> • <br /> DECISION: Based on review of the application materials,Shoreline Master Program regulations,and the <br /> City of Everett Municipal Code the Planning Director finds the proposal consistent with the Shoreline <br /> Master Plan,Shoreline Management Act,and applicable zoning codes and therefore APPROVES the <br /> Shoreline Substantial Development Permit and Landscape Modification request subject to compliance <br /> with the following conditions of approval: <br /> 1. Construction is not authorized until twenty-one (21) days from the date the Department of <br /> Ecology receives this decision, or until all review proceedings initiated within twenty-one days <br /> from the date of such filing have been terminated. <br /> 2. Any changes to the proposal require prior Planning Department approval; <br /> 3. Project must comply with Ordinance 3759-20'Interim Chapter 19.30 Flood Damage Prevention' <br /> and meet current FEMA maps and regulations; <br /> 4. No fill will be permitted anywhere on site; <br /> 5. Construction must be commenced or,where no construction activities <br /> are involved,the use or activity shall be commenced within two(2)years of the effective date of a <br /> shoreline permit.The city may,at its discretion, extend the two-year time period for a reasonable time <br /> based on reasonable factors, if a request for extension has been filed before the expiration date and <br /> notice of the proposed extension is given to parties of record and to the Department of Ecology. <br /> If a project for which a shoreline permit has been granted under these procedures has not been <br /> completed within five(5)years after the effective date of the permit, if a request for extension has been <br /> filed before the expiration date and notice of the proposed extension is given to parties of record and to <br /> the Department of Ecology,the permit shall, at the end of the five-year period, be reviewed and, upon a <br /> showing of good cause,the city shall do either of the following: <br /> 1.
