owner is completely responsible for taking all risks associated with any future potential for <br /> instability at the site or in the site vicinity. <br /> Life Safety Risk Assessment: We evaluated available historic aerial photographs and published <br /> maps including geologic maps, USGS quadrangles and topographic maps, and City GIS data. <br /> The ancient landslide mass is either inactive or has a slide movement characterized as`extremely <br /> slow (less than 1ft / 5 years)' in accordance with Transportation Research Board (TRB Special <br /> Report 176) classification. However, the landslide terrain and the vicinity area are such that, <br /> under normal conditions, there exists some potential for a future global slope failure, based on <br /> the slopes, distance to the fault zones, local geology, and especially if excessive cuts or grading <br /> or roads or extensively modifications of the terrain by anthropogenic activity, and forest loss <br /> occurs. In our opinion, the life safety risk to the occupants from such a slide can be accurately <br /> determined only by performing an extensive study involving extensive subsurface explorations, <br /> installation of inclinometers, detailed slope stability analyses, and detailed risk analyses. <br /> There is a likelihood of the occurrence of an event of a size and in a location that would cause <br /> casualties, damage, or disruption to an existing standard of safety at the site, especially during a <br /> seismic event; although a detailed slope stability analyses under seismic conditions was beyond <br /> our scope of services. The project site is located close to the landslide-prone area, and thus the <br /> expected location and extent of the effects of the reactivation of any ancient slides on the site <br /> area including on-site structures exists. The anticipated severity of the ancient landslide <br /> reactivation effects on the on-site structures and future structures can be determined only by <br /> performing extensive subsurface explorations and detailed slope stability analyses under static <br /> and seismic conditions. <br /> Limitation of Liability: Historically, with construction in such areas, there is always an inherent <br /> high risk associated with ground movement and/or settlements and related structural damage. <br /> Again, it is important that the owner understands these inherent high risks. The owner is <br /> completely responsible for taking all risks associated with any future potential for instability at the <br /> site or in the site vicinity. <br /> There has been a certain amount of variability in legal interpretations of liability of geotechnical <br /> engineers and geologists in regard to landslide-related losses; but the conclusions reached are <br /> general in nature and not necessarily valid in any specific court. Liability of geotechnical engineers <br /> and engineering geologists for landslide damages to home sites is based most often on the theory <br /> of negligence and occasionally on negligent misrepresentation.
