. t 1 • - • Section 4: The City Council shall cause to lie posted at each entrance to such building a notice tc read: "DC ^T E1'TTER. tli'TS `_'E TC ^CCLTr`r. City Council , City of Everett." Such notice shall remain posted until the recuired repairs are rlade or demolition is completed. Such notice shall not be removed without written Permission of the City Council end no person shall enter the building except for the purpose of making the required repairs i or of demolishing sane. Section. 5: In case the owner shall fail , neglect or refuse to comply with the notice to repair, rehabilitate , or to demolish and remove said building or structure or portion thereof, the City Council may order the owner of the building prosecuted as a violator of the provisions of this ordinance . Section 6: It shall be unlawful for any occupant to remain in or reside in any building whichhas been properly posted with notice as provided in Section 4 of this ordinance until such tine as said_ notice has been removed by the order of the -'it7r Council of said city. Section 7 : That in event the owner, or reputed owner, of the building or structure shall feel that the order of the City Council is arbitrary or capricious, then in that event he may give written notice of appeal within five days of ,i the date of the service of said notice upon hi_r;, requiring said i ruling to be presented to a board of examiners and appeals as ii created by this ordinance . The board of examiners and appeals shall then review the order of the city Council and shall either approve j or disapprove said order end shall file their findings within a reasonable period of time . Section 8: I board of examiners and appeals consist- , �! ing of five ( 5 ) members who are qualified by experience and training to pass upon matters pertaining to building safety and construction shall be appointed by the :'ayor of the City of Everett and shall ' hold office at his pleasure. The board shall adopt such reasonable ,! rules and regulations for conducting its investigations as it shall ! deem proper and shall render all decisions and findings in writing to the City Council with a duplicate copy to the appelant . Their decision shall be rendered within ten (10 ) days of the date of appeal and shall be final . Section 9: Ln "owner" under the terms of this ordinance shall include the record owner, and/or any person buying under the terns of a contract wherein he shall have the right of possession. Section 10 : Any person who shall violate any of the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shell be punished by a fine in any sum not exceeding? Three TTundred ( :300 .00 ) Dollars, or by imprisonment in the City Jail for a period not exceeding 7inety ( 90 ) days , or by both such fine and imprisonment. I 1 I' d i� f t ;
