. t 1 • <br /> - <br /> • <br /> Section 4: The City Council shall cause to lie <br /> posted at each entrance to such building a notice tc read: "DC ^T <br /> E1'TTER. tli'TS `_'E TC ^CCLTr`r. City Council , City of Everett." Such <br /> notice shall remain posted until the recuired repairs are rlade or <br /> demolition is completed. Such notice shall not be removed without <br /> written Permission of the City Council end no person shall enter <br /> the building except for the purpose of making the required repairs <br /> i or of demolishing sane. <br /> Section. 5: In case the owner shall fail , neglect <br /> or refuse to comply with the notice to repair, rehabilitate , or to <br /> demolish and remove said building or structure or portion thereof, <br /> the City Council may order the owner of the building prosecuted <br /> as a violator of the provisions of this ordinance . <br /> Section 6: It shall be unlawful for any occupant to <br /> remain in or reside in any building whichhas been properly posted <br /> with notice as provided in Section 4 of this ordinance until such <br /> tine as said_ notice has been removed by the order of the -'it7r <br /> Council of said city. <br /> Section 7 : That in event the owner, or reputed <br /> owner, of the building or structure shall feel that the order of <br /> the City Council is arbitrary or capricious, then in that event he <br /> may give written notice of appeal within five days of <br /> ,i the date of the service of said notice upon hi_r;, requiring said <br /> i ruling to be presented to a board of examiners and appeals as <br /> ii created by this ordinance . The board of examiners and appeals shall <br /> then review the order of the city Council and shall either approve <br /> j or disapprove said order end shall file their findings within a <br /> reasonable period of time . <br /> Section 8: I board of examiners and appeals consist- <br /> , <br /> �! ing of five ( 5 ) members who are qualified by experience and training <br /> to pass upon matters pertaining to building safety and construction <br /> shall be appointed by the :'ayor of the City of Everett and shall <br /> ' hold office at his pleasure. The board shall adopt such reasonable <br /> ,! rules and regulations for conducting its investigations as it shall <br /> ! deem proper and shall render all decisions and findings in writing <br /> to the City Council with a duplicate copy to the appelant . Their <br /> decision shall be rendered within ten (10 ) days of the date of <br /> appeal and shall be final . <br /> Section 9: Ln "owner" under the terms of this <br /> ordinance shall include the record owner, and/or any person buying <br /> under the terns of a contract wherein he shall have the right <br /> of possession. <br /> Section 10 : Any person who shall violate any of the <br /> provisions of this ordinance shall be guilty of a misdemeanor and <br /> upon conviction thereof shell be punished by a fine in any sum not <br /> exceeding?
