General requirement for federal authorization of any subaward; statutory authorization of subawards under the JAG Program statute. Generally, a recipient of an OJP award may not make subawards ("subgrants")unless the recipient has specific federal authorization to do so. Unless an applicable statute or DOJ regulation specifically authorizes(or requires)particular subawards, a recipient must have authorization from OJP before it may make a subaward. However, JAG subawards that are required or specifically authorized by statute(see 34 U.S.C. § 10152(a)and 34 U.S.C. § 10156)do not require prior approval.
