. . V r 0RDIiiTLI`?CE No. 307 3 . AN ORDINANCE providing for the improvement of the alley in block 11 and block 20, S. S. Sines Acre Tracts to Everett, being the alley between Paine Avenue and omith Avenue from a point 267 feet South of the South property line of 36th Street to the North property line of 38th Street, by the construction of a sewer together with the necessary appurtenances , and doing all other work as may be necessary in connection therewith to make a complete improvement , all in accordance with Resolution No. 5126 of the City of Everett ; creating a local improvement district ; creating a local improvement district fund therefor; providing for the payment of said improvement to be made by special assessment on the property in said district under the mode of payment by bonds. WHEREAS, by Resolution No. 5126 the City Council of the City of Everett has declared its intention to order the improvement , as above outlined, and to do all work in connection there;:ith to make a complete improvement, in accordance with the plans and specifications as prepared by the City Engineer of the city of Everett; and "iiITEREAS,the cost of the improvement may exceed the assessed value of the property, less improvements and less outstanding unpaid local improvement assessments; and WHEREAS, the City council has by unanimous vote held the improveme t to be necessary for the public health and benefit and has ordethe same . NOW, THEREFORE, TTIE CITY OF E Z'EPETT DOES ORDAIN: Section 1: Tlaat the City Council of Everett , by unanimous vote, finds the improverri;nt herein described to be necessary for the public health and benefit and so orders the improvement. Section 2: That the alley in Block 11 and bl ck 20, T. S. Sines Acre Tracts, being the alley between Paine Avenue and Smith Avenue, from a point 267 feet South of the Soilith property line of 36th Street to the North property line of 38th Street be improved by the construction of asewer, together with the necessary appurtenances, and doing all other work as may be necessary in connection therewith to make a complete improvement , all in accordance witn the plans and specifications prepared under the direction of the Engineer of the city of Everett , which plans and specifications are hereby approved and adopted. Section 3: That the cost and expense of such improve- ment , including all necessary incidental expense , shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement, except as provided by Chapter 141, Session Laws of 1923, or acts amendatory thereto, and the Crdinances of the City of .verett .
