r 1 r • • ORDINANCE No. 3071. .AN ORDINANCE providing for the improvement ofFEderal Street from 40th Street to 41st Street by the construction of a sewer, together with the necessary appurtenances, and doing all other work as may be necessary in connection therewith to make a complete improvement , all in accordance with Resolution No. 5123 of the City of Everett; creating a local improvement district; creating a local improvement district fund therefor; providing for the payment of said improvement to be made by special assessment on the property in said district under the mode of payment by bonds, and repealing Ordinance No. 3032 of the City of Everett . WHEREAS, by Resolution No. 5123 the City Council of the City of Everett :las declared its intention to order the improvement, as above outlined, and to do all work in connection therewith to make a complete improvement in accordance with the plans and specifications as prepared by the city Engineer of the City of Everett; and WHEREAS, the cost of the improvement may exceed the assessed value of the property, less improvements, and less outstanding unpaid local improvement assessments; and WfiEREAS, the City Council has by unanimous vote held the improvement to be necessary for the public health and benefit and has ordered the same . NOW, THEREFORE, Tf CITY OF EVERETT DOES ORDAIN: Section 1: l'hat the City Council of Everett , by unanimous vote , finds the improvement herein described to be necessary for the public health and benefit and so orders the improvement. Section 2: Lhet Federal Street from 40th Street to 41st Street be improved by the construction of a sewer together with the necessary appurtenances, and doing all other work as may be necessary in connection therewith to make a complete improvement, all in accordance with the plans and specifications prepared under the direction of the Engineer of the City of Everett , which plans and specifications are hereby approved and adopted. Section 3: that the cost and expense of such improve- ment , including all necessary incidental expense , shall be borne by and assessed against the property included in the CsseSsfent nvedis- trict herein created in accordance with law. The t shall not be liable in any manner for any portion of the costs and expenses of such improvement, except as provided by Chapter 141, Session Laws of 1923, or acts amendatory thereto, and the Ordinances of the City of Everett . Section 4: That there is hereby established a Local Improvement District to be known as Local Improvement District No. 562, , which district shall include the following described property, to-wit :
