• • <br /> MEMORANDUM OF AGREEMENT FOR COMBS MILL <br /> PRIVATE WATER ASSOCIATION <br /> CECIL AND HELEN STANLEY, OWNERS OF PROPERTY DESCRIBED UNDER <br /> EXHIBIT A HERETO, DESIGNATED LOT A HEREIN, AND CECIL AND HELEN <br /> STANLEY AND ALAN BUTTERFIELD, OWNERS OF LOT DESCRIBED UNDER <br /> EXHIBIT B HERETO, AND DESIGNATED LOT B HEREIN, AND GAYLE AND <br /> MRS. GAYLE SALMON, OWNERS OF PROPERTY DESCRIBED UNDER EXHIBIT C <br /> HERETO, AND DESIGNATED LOT C HEREIN, DO HEREBY MUTUALLY AGREE <br /> AS FOLLOWS: <br /> (1 ) These property owners hereby mutually form a private water <br /> association to be known as COMBS MILL WATER ASSOCIATION, to be <br /> comprised of the three lots designated herein and described as <br /> Exhibits A, B, and C, and described herein as Lots A, B and C. <br /> (2 ) The Association will enter into a private association <br /> water service contract with the City of Everett for water <br /> service for these three adjoining lots, upon such forms as are <br /> requested by the City of Everett. Water shall be serviced from <br /> the City of Everett Water Transmision line located immediately <br /> to the north of the lots herein described. All three lots <br /> owners agree to sign said contract for water service. <br /> (3 ) This agreement shall be deemed to be perpetual in nature <br /> and it is the intention to permanently provide water service to <br /> the lots designated herein through the City of Everett Water <br /> Transmission Line located to the North of these lots. The <br /> parties acknowledge that from time to time the City of Everett <br /> may require additional documents to be signed and executed by <br /> each of the then existing property owners in order to assure <br /> continued water service. The owners , their heirs, assigns and <br /> successors agree to execute such additional documentation as <br /> may be required by the City of Eevrett. The owners hereby <br /> further acknowledge that the City of Everett is not deemed to <br /> be a guarantor purveyor of continued water service. The lot <br /> owners who execute this Agreement and the contract or contacts <br /> with the City of Everett shall not be deemed to be guarantors <br /> in any manner that water service shall be continued <br /> indefinitely by the City of Everett, nor do they, or any of <br /> them, guarantee in any fashion under what terms and conditions <br /> the City of Everett will permit water service to be continued <br /> upon renewals of any contract(s) . <br /> (4 ) The Association shall be governed by a Board of Directors <br /> I \ ).- <br />
