Transitional Housing <br />Transitional housing includes supportive services for homeless persons or families for up to two years <br />and has as its purpose facilitating the movement of homeless persons and families into independent <br />living. <br />Review process and zones allowed <br />Under existing development regulations of EMC 19.05 Tables 5-1 Use Matrices, Group Housing, <br />Temporary Shelter is allowed with a conditional use permit in the UR3, UR4, NB, B, and MU zones (see <br />zoning and other maps here), except that larger facilities are allowed as an administrative use permit in <br />the 6 and MU zones, and all facilities are prohibited on the ground floor on TOD or pedestrian streets in <br />the 6 zone. Pursuant to RCW 35.21.915, a religious organization may host the homeless on property <br />owned or controlled by the religious organization in any zone. See below for a summary of the proposed <br />changes to review process and zones allowed, a strikethrough of the use matrix is in Exhibit E. <br />Conditional use to administrative use <br />The proposed amendments would provide a more streamlined review process by shifting conditional <br />use permit requirements to administrative use permits. Public notice would still be required and permits <br />would be appealable to the Hearing Examiner. <br />Light Industrial zones <br />The proposal would allow the newly defined Emergency Housing, Indoor Emergency Shelter, and <br />Outdoor Emergency Shelter uses in the LI zones (Group Housing, Temporary Shelter is currently <br />prohibited), consistent with the requirements of RCW 35.21.683 because Hotels are allowed in those <br />zones. <br />Temporary Extreme Weather Shelters <br />Allow the newly defined Temporary Extreme Weather Shelter use as a permitted use in the NB, B, MU, <br />and LI zones and as an administrative use in the UR3 and UR4 zones. In all zones, the shelter may only <br />operate during the period of extreme weather or environmental conditions. Temporary Extreme <br />Weather Shelters may only be hosted in single-family zones on property owned by religious <br />organizations. <br />Permanent Supportive Housing <br />Under existing regulations, Permanent Supportive Housing is regulated as the intersection of dwelling <br />and social services, and a proposed facility would need to address regulations for both uses. <br />The proposed amendments to EMC 19.05 Table 5-2 would add social services as an allowed use with an <br />administrative use permit in the R-S, R-1, R-2, R-2(A), and UR3 zones only as an accessory use to <br />permanent supportive housing or transitional housing, consistent with the requirements of RCW <br />35.21.683, because Dwellings are allowed in those zones. <br />Regulations <br />EMC 19.08.200 provides a detailed set of standards and regulations for what are currently labelled <br />outdoor encampments, safe parking areas, and tiny home communities (proposed to be re -labelled <br />Homeless Shelter and Housing). The recommended code amendment expands the applicability of the <br />section such that it also applies to indoor facilities (Indoor Emergency Shelters and Emergency Housing) <br />then updating performance standards that apply to all applicable uses and a specific subset of <br />requirements for outdoor emergency shelters. <br />A.
