I <br /> City of Everett 00 21 13 - 9 <br /> Water Filter Plant Emergency Generator Replacement WO#3587 <br /> ' after the Bidder determined to be not responsible has received the City's final <br /> determination. <br /> If the Contract Documents contain supplemental responsibility criteria, then a Bidder will <br /> be deemed not responsible if the Bidder does not meet those criteria, all as set forth in <br /> SECTION 00 2213, SUPPLEMENTAL INSTRUCTIONS TO BIDDERS. <br /> 1-02.15 Pre-Award Information <br /> Before awarding any contract,the City may require one or more of these items or actions <br /> of the apparent lowest responsible Bidder: <br /> 1. A complete statement of the origin, composition, and manufacture of any or <br /> all materials to be used, <br /> 2. Samples of these materials for quality and fitness tests, <br /> 3. A progress schedule, in a form the City requires, showing the order of and <br /> time required for the various phases of the Work, <br /> ' 4. A breakdown of costs assigned to any bid item, <br /> 5. Attendance at a conference with the Engineer or representatives of the <br /> Engineer, <br /> 6. Obtain, and furnish a copy of, a business license to do business in the City of <br /> Everett. <br /> 7. A copy of State of Washington Contractor's Registration, or <br /> 8. Any other information or action taken that is deemed necessary to ensure that <br /> the Bidder is the lowest responsible bidder. <br /> After Bid opening, but prior to award, the apparent successful Bidder shall, if requested <br /> by the City, attend a pre-award conference to respond to questions by the City regarding <br /> evaluation of Bids. The City will emphasize items such as insurance and bonding that <br /> will assist in prompt issuance of the Notice to Proceed. By conducting a pre-award <br /> conference, the City has not thereby waived its right to make determinations regarding <br /> responsiveness and responsibility of the Bidder. <br /> 1-03 AWARD AND EXECUTION OF CONTRACT <br /> 1-03.1 Consideration of Bids <br /> Bids will be evaluated by the City to determine which bid is the lowest responsive bid by <br /> a responsible bidder and which bid, if any, should be accepted in the best interest of the <br /> City. The right is reserved by the City to waive informalities in the bidding, accept a Bid of <br /> the lowest responsible Bidder, reject any or all Bids, republish the call for Bids, revise or <br /> cancel the Work, or require the Work to be done in another way if the best interest of the <br /> City is served. <br /> Within 5 days after the opening of Bids, a Bidder who wishes to claim error shall submit a <br /> notarized affidavit signed by the Bidder, accompanied by original work sheets used in the <br /> preparation of the Bid, requesting relief from the responsibilities of Award. The affidavit <br /> shall describe the specific error(s) and certify that the work sheets are the originals used <br /> in the preparation of the Bid. The Engineer will review the certified work sheets to <br /> determine the validity of the claimed error and make recommendation to the City. If the <br /> City concurs in the claim of error, the Bidder will be relieved of responsibility, and the bid <br /> 00 21 13 - 9 INSTRUCTIONS TO BIDDERS <br /> I <br />
