WASHINGTON STATE DEPARTMENT OF CORRECTIONS <br /> DATA SHARING TERMS AND CONDITIONS <br /> PURPOSE OF SHARING WADOC DATA <br /> A. WADOC DATA <br /> 1. Pursuant to this Agreement, the Washington State Department of Corrections, <br /> hereinafter referred to as the"Department"or"WADOC,"will provide data to the <br /> City of Everett, hereinafter referred to as "Requestor," as necessary for the <br /> gathering of statistics about the Individuals they come in contact with,and under <br /> the jurisdiction of the Department. All data and information provided to <br /> Requestor by Department pursuant to this Agreement is hereinafter referred to as <br /> "WADOC Data." <br /> 2. WADOC Data will include Category 3 — Confidential Information and Category <br /> 4 — Confidential Information Requiring Special Handling, based upon <br /> classification categories developed by the Washington State Office of the Chief <br /> Information Officer (hereinafter referred to as "OCIO"). Data will be on an <br /> individual-level and non-aggregated,with personal identifiers. <br /> B. DATA TRANSMISSION. WADOC Data will be securely transmitted to Requestor in <br /> accordance with applicable laws and policies on an as needed basis. <br /> II. USE OF DATA <br /> A. Requestor and its employees, agents, volunteers, contractors, and subcontractors <br /> (collectively referred to herein as "Requestor")with access to WADOC Data shall access <br /> and use such data only for the purposes set forth in this Agreement. This Agreement does <br /> not constitute a release of WADOC Data for Requestor's discretionary use. WADOC Data <br /> may be accessed only to carry out the responsibilities specified herein. Any ad hoc <br /> analyses or other use of WADOC Data not specified in this Agreement is not permitted <br /> without the prior written agreement of WADOC. <br /> B. Requestor shall comply with the policies,standards,and guidelines of the OCIO,the terms <br /> and conditions set forth in this Agreement, and all applicable state and federal laws, <br /> including, but not limited to, the Health Insurance Portability and Accountability Act <br /> (HIPAA), Pub. L. 104-191, as amended by the Health Information Technology for <br /> Economic and Clinical Health Act of 2009(HITECH),45 CFR Parts 160 and 164;the Family <br /> Educational Rights and Privacy Act (FERPA) 20 U.S.C. § 1232g; Substance Abuse and <br /> Mental Health Services Administration regulations on Confidentiality of Alcohol and <br /> Drug Abuse Patient Records, 42 CFR Part 2; the Uniform Health Care Information Act, <br /> chapter 70.02 RCW; the Washington State Criminal Records Privacy Act, chapter 10.97 <br /> RCW;and Criminal Justice Information Services,28 CFR Part 20. <br /> Washington State K12798 Page 1 of 9 <br /> Department of Corrections Attachment A <br />
