<br />commission or omission procures, aids, or abets such violation, shall subject to the enforcement <br />procedures established pursuant to Everett Municipal Code Chapter 1.20 be guilty of a misdemeanor and, <br />upon conviction, shall be punished by a fine not to exceed one thousand dollars and/or imprisonment for <br />a term not to exceed ninety days. Each day such violation continues shall be considered an additional <br />misdemeanor offense. <br /> <br />Section 35. Everett Municipal Code Section 14.56.150 is hereby amended to read as follows: <br /> <br />A violation of this chapter or violation of any order of the public works director or his/her designee <br />pursuant to this chapter shall be subject to the enforcement procedures established pursuant to Everett <br />Municipal Code Chapter 1.20 a misdemeanor punishable by a fine not to exceed five thousand dollars per <br />day or per occurrence. <br /> <br />Section 36. Everett Municipal Code Section 16.03.390(D) is hereby amended to read as follows: <br />D. Subsection 5601.7.1 of the IFC, entitled “Seizure of fireworks,” is hereby added: <br />5601.7.1 Seizure of fireworks. Fireworks seized pursuant to Section 5601.1.3 by the city fire marshal or <br />designee or the chief of police or designee or the State Fire Marshal may be disposed of immediately. <br />Exceptions: Fireworks seized from any person for being sold, offered for sale, and or stored with the <br />intent to sell may within 15 days after such seizure may wish to contest or petition the city fire marshal <br />to return the fireworks seized upon the grounds that such fireworks were illegally or erroneously seized. <br />Such petition shall conform to the appeal requirements established in shall request a hearing pursuant <br />to EMC Everett Municipal Code Chapter 1.20. <br />Section 37. Everett Municipal Code Section 16.005.040(A)(10) is here by amended to read as follows: <br /> <br />Board of Review <br /> <br />Any reference in this Code to the “Board of Appeal” is to the Board of Review under Everett Municipal <br />Code Chapter 16.64. The provisions of Everett Municipal Code Chapter 16.64, and not the provisions of <br />this Code, govern the Board of Review. Any person aggrieved by an order or action of the building official <br />or his or her designee who does not have an enforcement procedure pending pursuant to Chapter 1.20 <br />EMC, may, in accordance with Chapter 16.64 EMC, file a written request with the city clerk requesting a <br />determination by the Board of Review. <br /> <br />Section 38. Everett Municipal Code Section 16.20.080(C) is amended to read as follows: <br /> <br />C. Enforcement. The remedies provided in this section for violations of or failure to comply with provisions <br />of this chapter, whether civil or criminal, shall be cumulative and shall be in addition to any other remedy <br />provided by law. Any billboard or billboard structure which is not in compliance with all the provisions of <br />this chapter is an unlawful billboard. The enforcement procedure for this chapter shall be the enforcement <br />procedure established in Everett Municipal Code Chapter 1.20. <br /> <br />1. Civil Remedies. The violation of or failure to comply with any of the provisions of this chapter, <br />or the erection, use or display of any billboard or billboard structure not in compliance with all of <br />the provisions of this chapter is declared to be unlawful and a nuisance.
