Debarment and Suspension Certification for Subcontractors <br /> <br />The Agency agrees to include the following required language in all <br />subcontracts into which it enters resulting directly from the Agency’s duty to <br />provide services under this Agreement: <br /> <br />The lower tier subcontractor certified, by signing this Agreement, that <br />neither it nor its principals is presently debarred, suspended, proposed for <br />debarment, declared ineligible, or voluntarily excluded from participation in <br />this transaction by any Federal department or agency. <br /> <br />When the lower tier subcontractor is unable to certify to any of the <br />statements in the contract, such subcontractor shall attach an explanation <br />to the Agreement. <br /> <br />III. ADDITIONAL REQUIREMENTS <br /> <br />A. Service and Assistance Animals <br /> <br />Persons with disabilities may request a reasonable accommodation for any <br />assistance animal, including an emotional support animal, under both Title VI <br />of the Civil Rights Act of 1964, as amended (P.L. 88-352), and Section 504 of <br />the Rehabilitation Act of 1973 (29 USC § 794), as amended. <br /> <br />B. Procurement <br /> <br />Unless specified otherwise in this Agreement, the Agency shall procure all <br />materials, property, supplies, or services in accordance with the requirements <br />of 2 CFR § 200.318; Section 6002 of the Solid Waste Disposal Act, as amended <br />by the Resource Conservation and Recovery Act; 24 CFR § 135; and 24 CFR <br />§ 576.404. The Agency, in subcontracting, shall comply with 2 CFR § 321(b)(1- <br />5). <br /> <br />The Agency shall include the above clause, adapted for the proper parties, in <br />any subcontract, subject to the terms and conditions of Exhibit A. <br /> <br />C. Faith-Based Activities <br /> <br />The Agency shall comply with the provisions of 24 CFR § 576.406(b), which, in <br />part, prohibit the Agency from engaging in inherently religious activities, such <br />as worship, religious instruction, or proselytization, as a part of the programs or <br />services funded by this Contract. If the Agency conducts such activities, the <br />activities must be offered separately, in time or location, from the programs or <br />services funded under this Agreement, and participation must be voluntary for <br />the beneficiaries under this Agreement. <br />
