Exhibit A <br />BH-22-AR-04-198 <br />City of Everett <br />Page 1 of 19 <br /> <br />EXHIBIT A <br /> <br />SPECIFIC TERMS AND CONDITIONS <br /> <br />EVERETT CASE MANAGEMENT PROJECT <br /> <br />The County has appropriated funds from its portion of Coronavirus Local Fiscal Recovery <br />Funds (“CLFR”) pursuant to the American Rescue Plan Act (ARPA), PL 117-2, section <br />9901, codified at 42 USC Section 802 et seq. to be used to pay for Everett Case <br />Management Project as set forth in Exhibit B of the Agreement. These CLFR Terms and <br />Conditions apply to the Agency’s provision of Everett Case Management Project, for <br />which the County has agreed to pay an amount not to exceed the amount shown as the <br />Maximum Contract Amount on the Face Sheet. In case of conflict between these CLFR <br />Terms and Conditions and the Agreement, the following order of priority shall be used: <br />(1) CLFR Terms and Conditions, (2) Other Terms and Conditions governing funding <br />under this Agreement, and (2) Exhibit B of this Agreement. <br /> <br />Prior to execution of and receipt of payment under this Agreement, the Agency shall <br />provide the County the following documents completed to the County’s satisfaction: <br /> <br />x Statement of Work in the form attached hereto as Exhibit B. <br />x Contract Budget in the form attached hereto as Exhibit C. <br />x Certification Regarding Lobbying including Lobbying Disclosure Form in the form <br />attached hereto as Exhibit D. <br />x Civil Rights Assurances Certification in the form attached hereto as Exhibit E. <br />x Invoice with Agency Certification in the form attached hereto as Exhibit F. <br /> <br />I. TERMS AND CONDITIONS <br /> <br />Agency agrees to comply with Section 603(c) of the Social Security Act, <br />regulations as promulgated by the Department of Treasury (31 CFR Part 35) as <br />amended; Coronavirus State and Local Fiscal Recovery Funds Frequently Asked <br />Questions promulgated by the U.S. Department of the Treasury, as amended; and <br />Compliance and Reporting Guidance – State and Local Fiscal Recovery Funds as <br />promulgated by the U.S. Department of the Treasury, as amended. The Agency <br />shall also comply with regulatory requirements under the Uniform Guidance at 2 <br />CFR Part 200. <br /> <br />A. Compliance with Specific Laws, Regulations, and Agreements <br /> <br />The Agency also agrees to comply with all other applicable federal statutes, <br />regulations, and executive orders, and the Agency shall require compliance of <br />the same in any contract it enters into with other parties relating to this <br />Agreement.
