13. Public access improvements shall include provisions for persons with disabilities, where <br /> reasonably feasible. <br /> Staff Comment: The path through the site connecting 110th Street SE with 19th Ave SE <br /> is proposed to be comprised of wood chips, therefore not handicap accessible. This <br /> path does not provide direct shoreline access, its main value is to provide a more direct <br /> link through the development site towards the lake. <br /> 14. Required public access improvements shall be fully developed and available for public <br /> use at the time of occupancy of the use or activity unless there are mitigating <br /> circumstances and an assurance device acceptable to the Planning and Community <br /> Development Director is in place. <br /> Staff Comment: The improvements to Green Lantern Park towards which the applicant is <br /> making a financial contribution will not be completed prior to certificate of occupancy. <br /> Because a cash payment is being made, no assurance device is necessary. <br /> 22. The placement and design of structures on shoreline sites shall be done in a manner <br /> which is least detrimental to shoreline views and vistas. In certain instances this may be <br /> accomplished by orienting the length axis of the building and/operation parallel to the <br /> view line. This regulation applies even if off-site public access is provided. <br /> Staff Comment: Given the site topography, low profile buildings and surrounding land <br /> uses, no shoreline views are expected to be adversely affected. On-site views will be <br /> created, both from proposed dwellings, and a picnic area at the southeast corner of the <br /> site, elevated above 19th Ave SE. <br /> 23.Any building or structure within 200 feet of the ordinary high water mark, in excess of 35 <br /> feet in height shall provide data showing that it will not obstruct the view of a substantial <br /> number of residences on the areas adjoining such shorelines. This regulation does not <br /> apply to cranes, utility poles or other devices required to carry on water-dependent <br /> operations. The intent of this regulation is not to reduce the height limitation presently <br /> allowed in any multi-family zone.) This regulation applies even if off-site public access is <br /> provided. <br /> Staff Comment: The buildings will be three stories with pitched roofs, which will result in <br /> an approximate height of 35 feet. The nearest residences that potentially have lake <br /> views are directly to the east of the site. The project is not located in the line of sight <br /> between those residences and the lake. <br /> 3.9 Conservation Element <br /> Discussion on wetlands and buffers <br /> 6. Existing hydrologic connections between water bodies, water courses, and associated <br /> wetlands shall be protected and maintained. <br /> Staff Comment: A Category III stream extends south along the site's eastern property <br /> line, until it reaches a culvert which carries the water under SR 527 to the lake.
