Per the agreement, the payment will be made in <br />fourteen business days of receipt of the fully executed agreement. <br />Project summary statement: This worker's compensation claim involves a former <br />employee, who filed a worker's compensation claim in 2009. The claim was ultimately <br />denied on appeal to the Board of Industrial Insurance Appeals in 2019. <br />In 2022, the claimant appealed to Snohomish County Superior Court Cause No. 19-2- <br />08886-31. In exchange for this payment, the former employee agrees to voluntarily <br />dismiss his appeal with prejudice. This sidebar payment is not an acceptance of liability <br />for the City and will resolve all issues and appeal in worker's compensation claim # <br />SE10327. <br />With outside counsel, the City's legal and HR teams considered the expense and risk of <br />further litigation and what would best protect the City from future claim exposure in <br />negotiating the terms of the Settlement Agreement. <br />Recommendation (exact action requested of Council): Authorize the mayor to sign the <br />Settlement Agreement and Release for Robin J Wilcox Worker's Compensation Claim in <br />the amount of $70,000. <br />
