EVERETT <br /> WASHINGTON <br /> ORDINANCE NO. 3901-22 <br /> An Ordinance Relating to Uniform Code Enforcement Procedures, Repealing Everett Municipal Code <br /> Chapter 1.20, Adopting a New Chapter 1.20, and Amending Other Portions of the Everett Municipal <br /> Code to Update Applicable Cross-References. <br /> WHEREAS, <br /> A. The City Council values the health, safety, and welfare of the residents of Everett and recognizes <br /> that violations of the Everett Municipal Code ("EMC") provisions related to land use, zoning, <br /> building and the environment are nuisances to the community that shall be prioritized based on <br /> significance and severity. <br /> B. A centralized process for enforcing and abating violations of the EMC will create efficiencies for <br /> City staff to promptly and effectively respond to and enforce violations of the EMC by providing <br /> an opportunity for persons to voluntarily correct code violations; assessing monetary penalties <br /> rather than criminal penalties for code violations; providing an appeal hearing on alleged <br /> violations; and establishing a standard procedure to be used by the City to abate unsafe or <br /> unlawful conditions and to recover the City's expenses incurred in these efforts. <br /> C. The City Council desires to adopt the new Chapter 1.20—Uniform Enforcement Code, along with <br /> the necessary amendments to the EMC to repeal outdated cross-references and clarify code <br /> provisions as appropriate; and <br /> NOW THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Findings Adopted. The City Council hereby finds the foregoing recitals are adopted in <br /> support of this Ordinance. <br /> Section 2. EMC Amended.The Everett Municipal Code is hereby amended as set forth in Exhibits <br /> A and B attached and incorporated herein. <br /> Section 3. Corrections. The City Clerk and codifiers of the ordinance are authorized to make <br /> necessary corrections to this Ordinance including, but not limited to,the correction of scrivener/clerical <br /> errors, references, ordinance numbering, section/subsection numbers and any references thereto. <br /> Section 4. Severability. Should any section, paragraph, sentence, clause or phrase of this <br /> Ordinance,or its application to any person or situation,be declared unconstitutional or otherwise invalid <br /> for any reason, or should any portion of this Ordinance be preempted by state or federal law or <br /> regulation, such decision or preemption shall not affect the validity of the remaining portions of this <br /> Ordinance or its application to other persons or circumstances. The City Council of the City of Everett <br /> hereby declares that it would have adopted this Ordinance and each section, subsection, sentence, <br /> clause, phrase, or portion thereof irrespective of the fact that any one or more sections, subsections, <br /> clauses, phrases, or portions be declared invalid or unconstitutional. <br />
