y <br /> • <br /> ORDINANCE No. <br /> 3034 <br /> AN ORDIhtCE providing for the improvement of Baker <br /> Avenue from 15th Street to 16th Street by grading to proper <br /> grade , construction of one course Portland cement concrete <br /> pavement , installation of necessary drainage , construction of <br /> six inch concrete curb and twelve inch gutter on the West side <br /> of Baker Avenue North to South property line of 15th Street , <br /> making necessary water main changes, and doing all work <br /> necessary to make a complete improvement, in accordance with <br /> petition signed by the owners of more than Sixty percent of <br /> the lineal frontage and by owners of more than Seventy-five <br /> percent of the area within the proposed district petitioning <br /> for said improvement ; creating a local improvement district ; <br /> creating a local improvement district fund therefor , and <br /> providing for the payment of said improvement by special assess <br /> ment on the property in said district under the mode of payment <br /> by bonds. <br /> aHEREAS, there has been heretofore filed with the Cit <br /> Council of the City of Everett , a petition signed by the owners of <br /> more than Sixty percent of the lineal frontage and by owners of <br /> more than Seventy-five percent of the area within the proposed <br /> district , petitioning for said improvement , and upon examinatio • <br /> thereof the City Council has found the things set forth therein <br /> to be true; and <br /> ATHEREAS, the said petition has been referred to the <br /> Commissioner of Public e"orks to be examined by the said Coi:uiiss 'on- <br /> er and the City Engineer, and the Commissioner of Public 'gorks <br /> has filed with the City Council all data and information re- <br /> quired by law; and <br /> JHEPEAS, said Commissioner of Public eyorks has <br /> recommended to the City Council that the said improvement <br /> petitioned for be made , and it appearing to the City Council <br /> that the public Health, convenience and necessity require that <br /> such improvement be made . <br /> NOW, THEREFORE, TEE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That Baker Avenue from 15th Street to <br /> 16th Street be improved by grading to proper grade , construction <br /> of one course Portland cement concrete pavement , installation <br /> of necessary drainage, construction of six inch concrete curb <br /> and twelve inch gutter on the ;lest side of Baker Avenue North <br /> to South property line of 15th Street , making necessary water <br /> main changes, and doing all work necessary to make a complete <br /> improvement , all according to the plans and specifications <br /> prepared under the direction of the City Engineer, which plans <br /> and specifications are hereby adopted and approved. <br /> Section 2 : That the cost and expense of such <br /> improvement , including all necessary incidental expense , shall <br /> be borne by and assessed against the property included in the <br /> assessment district herein created in accordance with law. <br /> The City of Everett shall not be liable in any manner for any <br /> portion of the costs and expenses of such improvement , except <br /> as provided by Chapter 141 Session Laws of 1923 , or acts <br /> amendatory thereto, and the ordinances of the City of Everett . <br />
