y • ORDINANCE No. 3034 AN ORDIhtCE providing for the improvement of Baker Avenue from 15th Street to 16th Street by grading to proper grade , construction of one course Portland cement concrete pavement , installation of necessary drainage , construction of six inch concrete curb and twelve inch gutter on the West side of Baker Avenue North to South property line of 15th Street , making necessary water main changes, and doing all work necessary to make a complete improvement, in accordance with petition signed by the owners of more than Sixty percent of the lineal frontage and by owners of more than Seventy-five percent of the area within the proposed district petitioning for said improvement ; creating a local improvement district ; creating a local improvement district fund therefor , and providing for the payment of said improvement by special assess ment on the property in said district under the mode of payment by bonds. aHEREAS, there has been heretofore filed with the Cit Council of the City of Everett , a petition signed by the owners of more than Sixty percent of the lineal frontage and by owners of more than Seventy-five percent of the area within the proposed district , petitioning for said improvement , and upon examinatio • thereof the City Council has found the things set forth therein to be true; and ATHEREAS, the said petition has been referred to the Commissioner of Public e"orks to be examined by the said Coi:uiiss 'on- er and the City Engineer, and the Commissioner of Public 'gorks has filed with the City Council all data and information re- quired by law; and JHEPEAS, said Commissioner of Public eyorks has recommended to the City Council that the said improvement petitioned for be made , and it appearing to the City Council that the public Health, convenience and necessity require that such improvement be made . NOW, THEREFORE, TEE CITY OF EVERETT DOES ORDAIN: Section 1: That Baker Avenue from 15th Street to 16th Street be improved by grading to proper grade , construction of one course Portland cement concrete pavement , installation of necessary drainage, construction of six inch concrete curb and twelve inch gutter on the ;lest side of Baker Avenue North to South property line of 15th Street , making necessary water main changes, and doing all work necessary to make a complete improvement , all according to the plans and specifications prepared under the direction of the City Engineer, which plans and specifications are hereby adopted and approved. Section 2 : That the cost and expense of such improvement , including all necessary incidental expense , shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement , except as provided by Chapter 141 Session Laws of 1923 , or acts amendatory thereto, and the ordinances of the City of Everett .
