RESOLUTION NO. 7830 <br />A RESOLUTION Declaring an Emergency for Purposes of Waiving Competitive Bidding <br />Requirements for Clean-up, Removal and Replacement of Poles and Netting at Legion <br />Memorial Golf Course After Damage Caused by the Windstorm on November 4, 2022 <br />WHEREAS, <br />A.The City operates Legion Memorial Golf Course in North Everett. A neighbor of the golf course <br />is the Everett Community College’s Early Learning Center, which provides childcare for infants to <br />children age five. <br />B.Along the boundary between the golf course and the Early Learning Center are 80-foot poles <br />and netting that protect the Early Learning Center from golf balls. <br />C.A regional windstorm occurred on Friday night, November 4, 2022. The windstorm snapped <br />multiple poles with their attached golf netting system. Because of the wind and force placed on <br />the poles and cables while holding up broken poles, the foundations of the other poles on the <br />netting system were compromised. <br />D.Assessment of the remaining poles by a netting system specialist determined that the remaining <br />poles, being 25 years old with a 30-year life span, are compromised and should be removed and <br />replaced to avoid damage to neighboring facilities. <br />E.After the windstorm., Parks and Facilities staff contacted Net Services LLC, the original vendor <br />that installed the poles and netting. Net Services has responded with a proposal for about <br />$310,000, for clean-up, removal and replacement of the poles and netting. Parks and Facilities <br />staff recommend that the City contract with Net Services for this work as soon as possible. <br />F.The windstorm and resultant damage are unforeseen circumstances beyond the control of the <br />City of Everett that (a) present a real, immediate threat to the proper performance of essential <br />functions and (b) will likely result in material loss or damage to property, bodily injury, or loss of <br />life if immediate action is not taken. <br />NOW, THEREFORE, BE IT RESOLVED THAT: <br />1.Finding and Declaration of Emergency. As stated above, the windstorm and resultant damage is <br />an unforeseen circumstance beyond the control of the City of Everett that (a) presents a real,
