1. The entire area extending from the 700 block to the 1100 block of North Broadway, and <br /> two blocks east and west of this area of North Broadway; and <br /> 2. The entire area extending from the 1000 block to the 4100 block of Broadway, and two <br /> blocks east and west of this area of Broadway; and <br /> 3. The entire area of Evergreen Way extending from the 4700 block to the south city limits, <br /> and two blocks east and west of this area of Evergreen Way; and <br /> 4. The Silver Lake Rest Area on I-5 Milepost 188.09; and <br /> 5. The entire area extending from the 1000 block to the 3200 block of Hewitt Avenue and <br /> two blocks north and south of this area of Hewitt Avenue; and <br /> 6. The entire area extending from the 2500 block to the 4100 block of Colby Avenue, and <br /> two blocks east and west of this area of Colby Avenue; and <br /> 7. The entire area extending from Everett Avenue to the 4600 block of Rucker Avenue, and <br /> two blocks east and west of this area of Rucker Avenue; and <br /> 8. The entire area extending from the 1000 block to the 3000 block of Pacific Avenue, and <br /> two blocks north and south of this area of Pacific Avenue; and <br /> 9. The entire area extending from the 1000 block to Everett Avenue of West Marine Drive, <br /> and two blocks west of this area of West Marine View Drive. <br /> E. A person is deemed to have notice of the SOAP order when: <br /> 1. The signature of the person named in the order or their attorney is affixed to the bottom of <br /> the order, signifying that they have read the order and have knowledge of the contents of the <br /> order; or <br /> 2. The order recites that the person named in the order or the person's attorney appeared in <br /> person before the court. <br /> F. The written SOAP order shall contain the court's directives and shall bear the legend: <br /> "Violation of this order is a criminal offense under Chapter 10.24 EMC and will subject a violator <br /> to arrest." <br /> G. Whenever a SOAP order is issued under this section, and the person named in the order <br /> knows of the order, a violation of any of the provisions of the order is a gross misdemeanor. <br /> Upon the first such conviction, the person shall be punished by imprisonment for not less than 10 <br /> days and a fine of not less than two hundred fifty dollars. Upon the second conviction, the person <br /> shall be punished by imprisonment for not less than ninety days and a fine of not less than five <br /> hundred dollars. Upon the third or subsequent conviction, the person shall be punished by <br /> imprisonment for not less than one hundred eighty days and a fine of not less than one thousand <br /> dollars. The minimum sentence of confinement and fine required shall not be suspended or <br /> deferred. <br /> Section 3: Severability. <br /> Should any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its <br /> application to any person or situation be declared unconstitutional or invalid for any reason, such <br /> decision shall not affect the validity of the remaining portions of this ordinance or its application <br /> to any other person or situation. The City Council of the City of Everett hereby declares that it <br /> would have adopted this ordinance and each section, subsection, sentence, clause, phrase or <br /> portion thereof irrespective of the fact that any one or more sections, subsections, clauses, phrases <br /> or portions be declared invalid or unconstitutional. <br /> 4 <br />
