LEASE AMENDMENT NO. 2 <br /> THIS AMENDMENT ("Amendment") is dated for reference purposes September 30, <br /> 2022, by and between the CITY OF EVERETT (the "City") and HCR LLC, a Washington <br /> limited liability company and owner of Forest View Transitional Health (formerly Pleasant <br /> Acres) ("Tenant"). This Amendment No. 2 concerns the lease between Tenant and the City <br /> dated October 1, 2012, as amended by Amendment No. 1 dated October 1, 2017 (as amended, <br /> the "Lease"). The parties desire to further extend the Lease. <br /> Accordingly,the parties agree as follows: <br /> 1. Extension. In Amendment No. 1, the parties agreed to extend the Lease for <br /> Option Term One, which means the Lease expires on September 30, 2022. (In Amendment <br /> No. 1, the Option Term One is erroneously referred to as "Option 2.") The parties in this <br /> Amendment No. 2 agree to further extend the Lease for the Option Term Two, so that the Lease <br /> expires on September 30, 2027. <br /> 2. Full Force and Effect. The parties agree that the Lease remains in full force <br /> and effect without interruption, except as expressly modified by this Amendment. <br /> 3. Effective Date. The Effective Date of this Amendment No. 2 is September 30, <br /> 2022, regardless of the date of signatures and acknowledgements on this Amendment No. 2. <br /> The parties agree that the Lease did not terminate at the end of Option Term One, but instead <br /> has remained continuously in effect. <br /> 4.
