Resident may terminate this <br /> Agreement if Resident is a victim of domestic violence. Pursuant to RCW 59.18.575, Resident or other household <br /> member must make a request to terminate this Agreement within ninety(90)days of the date of the restraining order was <br /> issued or the police report was written. Resident that is the victim of domestic violence is responsible for the payment of <br /> rent for the month in which Resident terminated this Agreement unless the termination is in accordance with RCW <br /> 59.18.200(1). If the Leased Premises is occupied by other Residents,the obligation to pay rent will continue until the end <br /> of this Agreement. Resident must provide:a)a copy of the restraining order or emergency protective order lawfully issued <br /> within the last one hundred-eighty(180)days; or b) a copy of a written report, written within the last one hundred-eighty <br /> (180)days, by a peace officer employed by the state or local law enforcement agency acting in official capacity, stating <br /> that the Resident or household member has filed a report alleging that the Resident or a household member is a victim of <br /> domestic violence,sexual assault or stalking. <br /> Owner may terminate this Agreement or elect not to renew this Agreement if: a) Resident allows the person against <br /> whom the protective order has been issued or who was named in the police report of the act or acts of domestic violence, <br /> sexual assault or stalking to visit the Residential Community; or b) Owner reasonably believes that the presence of the <br /> person against whom the protection order has been issued or who was named in the police report that outlines the act or <br /> acts of domestic violence, sexual assault or stalking poses a physical threat to other Residents, household members, <br /> guests or employees or to a Residents'right to quiet possession of the Leased Premises. <br /> 25.5. Fair Housing. Owner shall comply with all applicable local, state, and federal non-discrimination and fair <br /> housing laws, including laws which prohibit discrimination on the basis of race, religion, ethnic origin, national origin, <br /> color,sex,age, physical or mental disability,or family status. <br /> 25.6. Cash is not acceptable as a form of payment.All monthly payments must be made by one(1)check <br /> not multiple checks. Partial payment of rent is not acceptable at any time; all payments must be made in full to <br /> include all amounts due. Post-dated or third party payments will not be accepted. <br /> 25.7. Misstatements on Application. Owner has relied on the statements and representation Residents <br /> made on the rental application for the Lease Premises in executing this Agreement. Residents agree that the discovery of <br /> any misstatements or misrepresentations of fact in the rental application shall be deemed a material and incurable breach <br /> of this Agreement and Owner may serve Residents with a three(3)day notice to terminate the tenancy pursuant to state <br /> law. <br /> 25.8. Proof of Occupancy. Residents agree that the receipt of mail by any individual not listed as a Resident <br /> or Occupant in this Agreement at the Leased Premises shall be proof of occupancy of that individual and a violation of <br /> this Agreement. <br /> 25.9. Force Majeure. To the fullest extent permitted by law, Owner shall be excused from performance or <br /> obligations under this Agreement in the event of an act of God, epidemic, war, acts of terrorism, flood, fire, tornado, <br /> hurricane, riot,or any other event beyond Owner's control. <br /> 26. DISCLOSURE. To the fullest extent allowed by law, Owner may provide information on Residents or Residents' rental <br /> history to business affiliates or upon reasonable request from an authorized agent of state or federal government or law <br /> enforcement agency. <br /> 27. WAIVER. Owner's failure on any occasion to require strict compliance with any provision of this Agreement or to <br /> exercise any rights arising hereunder shall not be deemed a waiver of Owner's right to subsequently enforce any such <br /> provision or to insist upon any such right. No custom or practice which may develop between the parties during the <br /> course of the tenancy shall be construed to waive the rights of Owner to enforce any provision of this Agreement. <br /> Owner's not enforcing or belatedly enforcing written-notice requirements, rental due dates, acceleration, liens, or other <br /> rights, or Owner's acceptance of rent after a notice of non-compliance or non-payment shall not be deemed a waiver <br /> under any circumstances. <br /> If Residents pay only a portion of rent or other charges due(partial payment),with the government or another entity being <br /> responsible for paying the remainder of the rent and/or other charges due, and the government or other entity actually <br /> pays its portion and Residents fail to pay its portion as agreed, then Residents agree that in such an instance receipt of <br /> any payment from the government or other entity does not constitute a partial payment and Owner may move forward <br /> with eviction proceeding against Residents, unless the parties agree and enter into a written non-waiver agreement. <br /> 28. SEVERABILITY. If any provision of this Agreement is legally invalid, or declared by a court to be unenforceable, such <br /> provision will be deemed deleted and the rest of this Agreement shall remain in effect.
