Section 6: Sick Leave While on Vacation <br /> It is understood and agreed that sick leave is to be used only in circumstances where an employee is <br /> scheduled to work and is unable to do so because of personal illness or injury. Therefore,if an employee <br /> becomes ill or injured once their vacation has commenced,vacation time will be deducted unless the <br /> employee provides certification of overnight hospitalization for which sick leave will be substituted for a <br /> regularly scheduled vacation day(one day for each night of hospitalization). However,if the employee <br /> notifies the Department Head or their designee prior to the commencement of the employee's vacation <br /> that said employee is ill or injured,sick leave may be used for any days which the employee would have <br /> been scheduled for vacation. In such cases,the vacation will be canceled and rescheduled,if possible,at <br /> a time mutually agreeable to the City and the employee. <br /> Section 7: Sick Leave and Vacation Accrual While Receiving Industrial Insurance Benefits <br /> It is understood and agreed that for the period in which an employee is receiving benefits pursuant to the <br /> Industrial Insurance Act,they shall not be entitled to accrual of sick leave and/or vacation time as set <br /> forth in Articles 11 and 13 of this Agreement. This section shall not prevent an employee from using sick <br /> leave or vacation benefits which have previously been earned to supplement the payment of industrial <br /> insurance benefits. For those hours of sick leave and/or vacation used to supplement industrial insurance <br /> benefits,the employee shall be entitled to accrue additional sick leave and/or vacation hours. <br /> Section 8: <br /> An employee's ability to work regularly and as scheduled is a requirement for continued employment. <br /> The City has the right to take corrective action to deal with unauthorized use of sick leave. <br /> Section 9: <br /> Subject to the Civil Service rules,the head of any department may discipline(including suspension or <br /> dismissal)any employee who uses sick leave under false pretenses. The City may request a doctor's <br /> statement for any sick leave provided there is evidence of unauthorized sick leave use. The request for <br /> the doctor's statement will be made following a determination of the possible sick leave abuse by a <br /> department head. <br /> Section 10: <br /> Employees who have successfully passed probation shall be allowed,upon separation,to receive in cash <br /> an amount equal to twenty(20%)of the value of their then existing sick leave accrual balances. <br /> 32 <br />
