December 14, 2022 <br /> <br />17 <br /> <br /> <br />COUNCIL BILL 2211-60 <br /> <br /> THIRD AND FINAL READING: <br /> <br />AN ORDINANCE establishing an Everett Station District Alliance Business <br />Improvement Area (BIA), as amended <br /> <br />Discussion ensued regarding guardrails, accounting, and BIA communication. <br /> <br />Moved by Council Member Tuohy, seconded by Council Member Rhyne, to <br />create a new section and add the following language to the ordinance, “The <br />boundaries of the BIA shall not be expanded without Council approval, following <br />the same procedures, including notice to affected property owners, as is <br />required for establishment of the original BIA.” <br /> <br />Roll was called with all council members voting yes. <br /> <br /> Motion carried. <br /> <br />Moved by Council Member Zarlingo, seconded by Council Member Schwab, to <br />strike Section 8 in its entirety and replace it with the following: <br /> <br />“Section 8. Administration. <br /> <br />The ESDA BIA Fund shall be maintained by the City. To administer the account, <br />the City Finance Director or their designee is authorized to: <br /> <br />A. Collect special assessments based on data and information provided <br />by the ESDA. <br />B. Refund special assessments when overpaid and extend the deadline <br />for payment and/or waive delinquency charges whenever the <br />delinquency is the result of the failure by the City to provide a <br />statement of the amount due, or nonpayment results from <br />extenuating circumstances that are reasonably beyond the ratepayer’s <br />control, such as a casualty loss, causing bankruptcy.
