111 <br /> 3 <br /> Lease#: <br /> Site Name: Southend Police Precinct Ai <br /> 4 <br /> ,, �`r ..,r- <br /> COMMUNICATION SITE LEASE , <br /> THIS COMMUNICATIONS SITE LEASE (this "Lease") is made by and between the City <br /> of Everett, a municipal corporation and political subdivision of the State of Washington,hereinafter <br /> called "Lessor," and Snohomish County Emergency Radio System, a Washington interlocal non- <br /> profit Corporation ("SERS"or"Lessee"). <br /> RECITALS <br /> 1. SERS is developing and installing a trunked 800 Megahertz ("MHz") public safety <br /> and emergency radio system including the equipment and infrastructure necessary together with <br /> mobile computing infrastructure, a simulcast VHF alphanumeric paging system (collectively the <br /> "Radio System") and related radio and electronic systems. <br /> 2. SERS, in providing public safety and emergency communications through the Radio <br /> System, needs to locate communications equipment and facilities at various locations to insure the <br /> required coverage for communications is achieved. <br /> 3. Lessor has certain real property that SERS has determined would be beneficial for <br /> its public safety communications coverage requirements. <br /> 4. SERS and Lessor have determined that SERS use of Lessor's property is acceptable <br /> under the terms and conditions of this Lease. <br /> AGREEMENT <br /> In consideration of the mutual covenants contained in this Lease,the parties agree as <br /> follows: <br /> 1. Premises: Lessor agrees to lease to SERS and SERS agrees to lease from Lessor, <br /> upon the terms and conditions set forth herein, Premises located in Snohomish County, <br /> Washington, comprising, as of the commencement date of this Lease, the area as shown on the <br /> Area Map and Site Plans, attached to this Lease, along with the legal description, as Exhibit A, <br /> for the placement of certain communications equipment and structures (the "Site" or the <br /> "Premises"); the equipment and structures are described and specified in Exhibit B (the <br /> "Equipment and Structures List") attached hereto. <br /> 2. Term: The initial Lease Term shall be for Fifteen (15)years and shall commence <br /> on June 1, 2002 and shall end on June 1, 2017,unless terminated sooner as provided herein and in <br /> 1of� <br />
