City of Everett 00 7200 - 5 <br /> 2023 Biosolids Removal UT 3808 - 2 <br /> Total Float: The amount of time any given activity or path of activities may be delayed before it will <br /> affect the Completion Date. <br /> Traffic: Both vehicular and non-vehicular traffic,such as pedestrians,bicyclists,wheelchairs, and <br /> equestrian traffic. <br /> Unabsorbed Overhead: The reduction or loss of contribution to recovery of the Contractor's Overhead <br /> costs realized by the result of reduced Project or Contractor billings, or both, due to any reason <br /> whatsoever,including a Project extension. <br /> Unit Price Work: Refers to items of Work identified by unit prices in the Bid form. <br /> Work: Refers to the Project and the provision of all labor,materials,Equipment,supplies, services, and <br /> other items necessary for the execution, completion and fulfillment of the Contract. <br /> 1.2. CONTRACT DOCUMENTS <br /> The complete Contract includes the following,which are Contract Documents: <br /> 1. Federal and state requirements that apply to this Contract and Project; <br /> 2. Supplemental agreements between Owner and Contractor,if any,subsequent to the Owner's <br /> ' execution of the Contract and signed by the Mayor of the City of Everett for Owner and by an <br /> authorized representative of Contractor <br /> 3. Change Orders; <br /> 4. Addenda; <br /> 5. The Contract; <br /> ' 6. Bid Form; <br /> 7. Specifications, including,but not limited to,these General Conditions and other numbered <br /> Documents and Sections; <br /> 8. Supplementary Conditions, if any; <br /> 9. Drawings and plans; <br /> 10. City of Everett standard plans in effect as of the date Bids are opened; <br /> 11. Notice to Bidders/Instructions to Bidders; and <br /> 12. Certifications and affidavits as required by this Contract and by law. <br /> Any inconsistency in the parts of the Contract shall be resolved by following this order of precedence in <br /> the list above(e.g., 1 presiding over 2, 3,4, 5,and 6; 2 presiding over 3,4, 5,and 6; and so forth). This <br /> order of precedence shall not apply when Work is required by one part of the Contract but omitted from <br /> another part or parts of the Contract. The Work required in one part must be furnished even if not <br /> mentioned in other parts of the Contract. <br /> These parts complement each other in describing the complete Work. Any requirement in one part binds <br /> as if stated in all parts. The Contractor shall provide any work or materials clearly implied in the Contract <br /> even if the Contract does not mention it specifically.Any inconsistency in the parts of the Contract shall <br /> be referred to the Owner's Representative attention for a determination of the intended requirements. <br /> The Work required in one part must be furnished even if not mentioned in other parts of the Contract. If <br /> any part of the Contract requires Work that does not include a description for how the Work is to be <br /> performed,the Work shall be performed in accordance with standard trade practice(s). For purposes of <br /> the Contract,a standard trade practice is one having such regularity of observance in the trade as to justify <br /> an expectation that the Contractor will follow or observe the practice in performing the Work. In case of <br /> any ambiguity, disagreement or Dispute over interpreting the Contract,the Owner's Representative's <br /> ' decision will be final as provided in these General Conditions. <br /> ' 00 7200 - 5 GENERAL CONDITIONS <br />
