o // ORDINANCE No. 3011. AN OF DIN/,, CE providing for the improvement of the alley between Colby Avenue and Hoyt Avenue from 25th Street to 26th Street by grading to proper grade, installation of necessary drainage and surfacing with bituminous plant mix, and doing all work necessary to make a complete improvement in accordance with a majority petition therefor; creating an assessment district; creating a local improvement district fund therefor; providing for the payment of said improvement by special assessment on the property in said district under the mode of payment by bonds. WHEREAS, there has been heretofore filed with the City Council of the city of Everett a majority petition of the property owners petitioning for said improvement , and upon examination thereof the said City Council has found the things set forth therein to be true ; end WHEREAS, the said petition has been referred to the Commissioner of Public Works to be examined by said Commissioner and the City Engineer, and the Commissioner of Public Works has filed with the city Council all data and information required by law; end WHEREAS, said Commissioner of Public Works hes recommended to the City Council that said improvement petitioned for be made, and it appearing to the City Council that the public health, convenience and necessity require that such improvement be made. NOW, THEREFOFE , THE CITY OF EVERETT DOES ORDAIN: Section 1: That the alley between Colby Avenue and Hoyt Avenue from 25th Street to 26th Street be improved by grading to proper grade, installation of necessary drainage and surfacing with bituminous mix, and doing all work necessary to make a complete improvement all according to the plans and specifications prepared under the direction of the City Engineer, which plans and specifications are hereby adopted and approved. Section 2: That the cost and expense of such improve- ment, including all necessary incidental expense, shall be borne by End assessed against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement, except es provided by Chapter 141 , Session Laws of 1923, or acts amendatory thereto and the ordinances of the City of Everett. Section 3: That there is hereby established a local improvement district to be known es "Local Improvement District No. 560 , " which district shall include the following described property located in Everett, Snohomish County, Washington, to-wit:
