Statutes and regulations prohibiting discrimination applicable to this Contract include, without <br />limitation, the following: <br />• Title VI of the Civil Rights Act of 1964 (42 U.S.C. §§ 2000d et seq.) and Treasury's <br />implementing regulations at 31 C.F.R. Part 22, which prohibit discrimination on the basis <br />of race, color, or national origin under programs or activities receiving federal financial <br />assistance; <br />• The Fair Housing Act, Title VIII of the Civil Rights Act of 1968 (42 U.S.C. §§ 3601 et seq.), <br />which prohibits discrimination in housing on the basis of race, color, religion, national <br />origin, sex, familial status, or disability; <br />• Section 504 of the Rehabilitation Act of 1973, as amended (29 U.S.C. § 794), which <br />prohibits discrimination on the basis of disability under any program or activity receiving <br />federal financial assistance; <br />• The Age Discrimination Act of 1975, as amended (42 U.S.C. §§ 6101 et seq.), and <br />Treasury's implementing regulations at 31 C.F.R. Part 23, which prohibit discrimination on <br />the basis of age in programs or activities receiving federal financial assistance; and <br />D. Title II of the Americans with Disabilities Act of 1990, as amended (42 U.S.C. §§ 12101 et seq.), <br />which prohibits discrimination on the basis of disability under programs, activities, and services <br />provided or made available by state and local governments or instrumentalities or agencies <br />thereto. ARPA funds may only be used to pay for or reimburse eligible costs as described in the <br />Contract, including without limitation the Purchase Order and these ARPA Contract Terms. No <br />funds may be used to pay or reimburse costs for which Contractor has received any other funding, <br />whether state, federal or private in nature. <br />E. The Contractor shall execute and meet the requirements of the following, each of which is <br />incorporated herein by reference: Certificate of Non -Debarment or Suspension, Civil Rights <br />Certification Form, Lobbying Certification Form (if applicable), and Lobbying Disclosure Form (if <br />applicable). <br />F. Prior to any payment by the City under the Contract, Contractor shall submit an invoice, a Cost <br />Certification, and any supporting documentation. <br />2. SIMPLIFIED ACQUISITION THRESHOLD <br />Contracts for more than the simplified acquisition threshold, which is the inflation adjusted amount <br />determined by the Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council <br />(Councils) as authorized by 41 U.S.C. § 1908, or otherwise set by law, must address administrative, <br />contractual, or legal remedies in instances where contractors violate or breach contract terms, and <br />provide for such sanctions and penalties as appropriate. (Note that the simplified acquisition threshold <br />determines the procurement procedures that must be employed pursuant to 2 C.F.R. §§ 200.317- <br />200.327.) The simplified acquisition threshold does not exempt a procurement from other eligibility or <br />processes requirements that may apply. <br />Page 4 of 24 <br />
