• <br /> • <br /> ORDINANCE No. <br /> 9 6. , <br /> AN ORDINAN?CE amending Section 3 of Ordinance No. 1586 <br /> of the City of Everett, entitled as follows: <br /> "An Ordinance for the protection of life and <br /> limb, and relating to excavations in, under or near, <br /> obstructions to, and use of the streets, alleys, <br /> sidewalks and public places in the City of Everett , <br /> repealing Ordinances Nos. 23 and 714, prescribing <br /> punishment for violation thereof, and declaring an <br /> emergency," <br /> and declaring an emergency. <br /> THE CITY OF EtiERETT DOES ORDAIN: <br /> Section 1: That Section 3 of Ordinance No. 1586, <br /> entitled as above set forth, be , and the same is hereby amended <br /> to read as follows: <br /> Section 3: All excavations, obstructions or unsafe <br /> conditions in or upon any street, alley, sidewalk, or public <br /> place in said City shall be protected and guarded by sufficient <br /> barriers at all times and by red rectors at night so as to <br /> warn passers by of such obstruction or dangerous place; and <br /> all such excavations, obstructions, and unsafe conditions shall <br /> be properly filled up, and the street , alley, sidewalk, or <br /> public place restored to its fora r condition upon the completio <br /> of the purpose for which same was torn up, obstructed or <br /> rendered unsafe; and it shall be the duty of the person creati _a <br /> such excavation, obstruction, or unsafe condition, or causing <br /> the sane to be created, to do and perform all the acts herein <br /> required to be done concerning the same, and it shall be the dut <br /> of the Superintendent of Streets of said City to see that the <br /> provisions of this section are fully and faithfully observed. <br /> Said red reflectors herein referred to shall be of such size <br /> and Mlle as the City Engineer shall ap,:rove. <br /> :section 2: An emergency is hereby declared to <br /> exist and this Ordinance shall take effect upon its passage <br /> and publication. <br /> Mayor <br /> Attest : <br /> 91704 City Clerk <br /> Passed' November 24, 1942. <br /> November 25 , 1942. <br /> Published: <br />
