ORDINANCE No. AN ORDINANCE providing for the improvement of Walnut Street from Hewitt Avenue to center line of California Street, by grading to proper grade , construction of Portland cement concrete curbs and gutters , surfacing with 2" bituminous plant mix "F" , installation of necessary drainage , removal and re- placing of broken sidewalks, and doing all other work necessary to make E complete improvement in accordance with a majority petition therefor ; creating an assessment district ; creating a local improvement district fund tiirefor, and providing for the payment of not less than Twenty-five percent (25co) of said improve- ment out of the City Street Fund , nd the balance of said improve- ment shall be paid by special assessment on the property in said district under the mode of payment by bonds. is H REj,S, there has been heretofore filed with the City Council of the City of Everett a majority petition of the property owners petitioning for said improvement and upon ex- amination thereof the said City Council has found the things set forth therein to be true; and WHEREAS, the said p tition has been referred to the Commissioner of Public 'Works to be examined by the said Commissioner and the City -engineer, and the Commissioner of Public Works has filed with the City Council all data and information required by law; and WHEREAS, said Commissioner of Public 'Yorks has recomnend:d to the City Council that said improvement petitioned for be made, and it appearing to the City Council that the public health, convenience and necessity require that such improvement be made. NON, TiThREFORE , TIE CITY OF EVERETT DOES ORDAIN: Section 1 : That ' alnut Street from Hewitt Avenue to center line of California Street be improved by grading to proper grade , construction of Portland cement concrete curbs and gutters and surfacing with 2" bituminous plant mix "F", in- stallation of necessary drainage, removal and replacing of broken sidewalks and doing all other work necessary to make a complete improvement , all according to the plans and specification's prepared under the direction of the City Engineer, which plans and specifications are hereby adopted and approved. Section 2 : That not less than Twenty-five percent (25c0) of the cost and expense of such improvement shall be paid out of the City S+reet li'und and the balance of such improvement shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement , except as provided by Chapter 141 Session Laws of 1923, or acts amenda- tory thereto, and the ordinances of the City of Everett, and the portion to be paid from City Street Fund .
