and <br /> WHEREAS, with regard to the properties located on the east side of East Marine View Drive, <br /> south of Hayes Street, the City Council finds: <br /> 1. The subject area was previously zoned C-1 prior to the adoption of the City's Growth <br /> Management Comprehensive Plan in 1994; <br /> 2. The area was designated"light industry"by the 1994 adoption of the City's Growth <br /> Management Comprehensive Plan; <br /> 3. The City initiated rezoning of the area following adoption of the comprehensive plan in <br /> order to make the zoning map consistent with the comprehensive plan land use <br /> designation for the area, and adopted C-2 zoning for the area in January, 1995; <br /> 4. Mr. Gary Davis owns property in the subject area which contains a single family <br /> dwelling, which is a nonconforming use in the C-2 zone; <br /> 5. Mr. Davis has stated his desire to replace the single family dwelling with a duplex, but <br /> the C-2 zoning of the property does not allow housing; <br /> 6. The City's nonconforming use regulations do not allow a nonconforming residential use <br /> to be increased in density; <br /> 7. The subject area includes a mix of land uses, including residential, office, warehouse uses <br /> consistent with the requested C-1 zoning; <br /> 8. The subject area is abutted by M-2 (Heavy Manufacturing) zoning and the BNSF rail <br /> yard to the east; <br /> 9. The subject area is located across East Marine View Drive from C-1 (General <br /> Commercial) and P (Public Park) zoning; and <br /> 10. Changing the land use designation to "Community Business"will, with implementing <br /> rezoning, make all existing uses within the subject area conforming uses, thereby <br /> promoting the best long term interests of the Everett community; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. The Land Use Map designation for properties located on the east side of East Marine <br /> View Drive, south of Hayes Street, as depicted on the attached map attached hereto as Exhibit A, <br /> is hereby amended from 5.3 "Light Industry"to 4.2 "Community Business." <br />
