Federal Transit Administration Clauses <br /> <br />8 <br /> <br />a. At least 51 percent of which is owned by one or more socially and economically <br />disadvantaged individuals or, in the case of any publicly owned business, at least 51 percent <br />of the stock of which is owned by one or more socially and economically disadvantaged <br />individuals; and, <br />b. The management and daily business operations of which are controlled by the socially and <br />economically disadvantaged individuals who own the business. <br />2. Socially and Economically Disadvantaged Individuals are those individuals who are citizens of the <br />United States (or lawfully admitted permanent residents) and who are: <br />a. Black Americans - which includes persons having origins in any of the black racial groups of <br />Africa; <br />b. Hispanic Americans - which includes persons of Mexican, Puerto Rican, Cuban, Central or <br />South American or other Spanish or Portuguese culture or origin, regardless of race; <br />c. Native Americans - which includes persons who are American Indians, Eskimos, Aleuts or <br />Native Hawaiians; <br />d. Asian-Pacific Americans - which includes persons whose origins are from Japan, China, <br />Taiwan, Korea, Vietnam, Laos, Cambodia, the Philippines, Samoa, Guam, the U.S. Trust <br />Territories or the Pacific and the Northern Marianas; <br />e. Asian-Indian Americans - which includes persons whose origins are from India, Pakistan and <br />Bangladesh; <br />f. Women - regardless of race, ethnicity or origin; and, <br />g. Other - individuals found to be socially and economically disadvantaged by the Small <br />Business Administration (SBA) pursuant to Section 8(a) of the Small Business Act. <br />D. Disadvantaged Business Enterprises <br />1. This contract is subject to the requirements of Title 49, Code of Federal Regulations, Part 26, <br />Participation by Disadvantaged Business Enterprises in Department of Transportation Financial <br />Assistance Programs. The national goal for participation of DBEs is 10%. The agency’s overall <br />goal for DBE participation is 2%. A separate contract goal has not been established for this <br />procurement. <br />2. The successful bidder/Bidder will be required to report its DBE participation obtained through <br />race-neutral means throughout the period of performance. <br />3. The contractor must promptly notify the City of Everett, whenever a DBE subcontractor <br />performing work related to this contract is terminated or fails to complete its work, and must <br />make good faith efforts to engage another DBE subcontractor to perform at least the same <br />amount of work. The contractor may not terminate any DBE subcontractor and perform that <br />work through its own forces or those of an affiliate without prior written consent of the City of <br />Everett. <br />E. Affirmative Efforts to Solicit DBE Participation
