Comply with federal requirements and follow federal guidance to avoid or mitigate adverse <br />effects on historic properties. <br />H. Indian Sacred Sites. The Recipient agrees to, and assures that its Third Party Participants will, <br />facilitate compliance with federal efforts to promote the preservation of places and objects of <br />religious importance to American Indians, Eskimos, Aleuts, and Native Hawaiians, and facilitate <br />compliance with the American Indian Religious Freedom Act, 42 U.S.C. § 1996, and Executive Order <br />No. 13007, “Indian Sacred Sites,” May 24, 1996, 42 U.S.C. § 3161 note (61 Fed. Reg. 26771). <br />I. Mitigation of Adverse Environmental Effects. <br />1. The Recipient agrees to comply with all environmental mitigation measures that may be <br />identified as conditions that the Federal Government might 87 impose in its finding of no <br />significant impact or record of decision or commitments in the environmental documents that <br />apply to the Award, such as environmental assessments, environmental impact statements, <br />categorical exclusions, memoranda of agreement, documents required under 49 U.S.C. § 303, <br />and other environmental documents. <br />2. The Recipient agrees that: <br />a. Any mitigation measures agreed on will be incorporated by reference and made part of the <br />Underlying Agreement and any Amendments thereto; <br />b. Any deferred mitigation measures will be incorporated by reference and made part of the <br />Underlying Agreement and any Amendments thereto as soon as agreement with the <br />Federal Government is reached; and <br />J. Any mitigation measures agreed on will not be modified or withdrawn without the written approval <br />of the Federal Government. <br />44. FEDERAL “$1 COIN” REQUIREMENTS <br />The City of Everett agrees to comply with section 104 of the Presidential $1 Coin Act of 2005, 31 U.S.C. <br />§ 5112(p), therefore its equipment and facilities will be fully capable of accepting and dispensing $1 <br />coins when coins or currency are required to use that equipment or those facilities, and it will display <br />signs and notices of the $1 coin capability of its equipment and facilities on its premises, including <br />vending machines, where coins or currency are used. <br />45. CENTERS FOR DISEASE CONTROL AND PREVENTION ORDER ON <br />REQUIREMENTS FOR PERSONS TO WEAR MASKS WHILE ON <br />CONVEYANCES AND AT TRANSPORTATION HUBS <br />A. Compliance with CDC Mask Order. The Centers for Disease Control and Prevention (“CDC”) Order of <br />January 29, 2021, titled Requirement for Persons to Wear Masks While on Conveyances and at <br />Transportation Hubs (“CDC Mask Order”), is within the meaning of “Federal Requirement” as that <br />term is defined in this Master Agreement. One of the objectives of the CDC Mask Order is <br />“[m]aintaining a safe and operating transportation system.” The Recipient agrees that it will <br />comply, and will require all Third-Party Participants to comply, with the CDC Mask Order.
