II, , <br /> ORDINANCE No. <br /> 2916. <br /> AN OTDINANCE relating to the unlawful wearing of the <br /> uniform of the United States Army, Navy, Marine Corps and Coast <br /> Guard; defining offenses, prescribing penalties and declaring <br /> an emergency. <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: It sh11 be unlawful for any person <br /> not an officer or enlisted man of the United States Army, Navy, <br /> Marine Corps, or Coast Guard, to wear the uniform thereof, <br /> or any distinctive pert of such uniform or a uniform any part <br /> of which is similar to a distinctive part of the duly prescribed <br /> uniform thereof: Provided , that the foregoing provision shall <br /> not be construed to apply to any person authorized to wear such <br /> uniform by the laws of the United States, and in particular <br /> Section 125 of the National Defense Act as amended (10 U.S. C.A. , <br /> Section 1393) . <br /> Section 2 : Violation of any of the provisions of <br /> this ordinance shall be punishable by a fine not exceeding Three <br /> Hundred Dollars („�300 .00 ) , or by imprisonment in the City Jail <br /> not exceeding Ninety ( 90) days, or by both such fine and <br /> imprisonment. <br /> Section 3 : TaEREAS, protection of the uniform of <br /> the armed forces of the United States is not specifically <br /> provided for by local or state law in aid of Federal Laws for <br /> the protection thereof; and, WHEREAS, Federal authorities have <br /> requested the City to enact local legislation in eid of the <br /> prevention of wearing of the uniform by persons not lawfully <br /> entitled to wear the same; and, I.JEREA.S, the public safety is <br /> endangered by the unauthorized wearing of such uniform, thereby <br /> creating a situation constituting an emergency, which is hereby <br /> declared to exist , which is necessary for the immediate pre- <br /> servation of the public peace, health and safety that this <br /> ordinance become effective without delay; N01, "TTEREFORE, an <br /> emergency is declared to exist and this ordinance shall take <br /> effect upon its passage and publication. <br /> ,_zi—t:7 . <br /> i7ay or <br /> Attest: <br /> City Clerk <br /> Passed: May 27, 1941 . <br /> Publ i shed: May 28, 1941. <br />
