2yi_75 <br /> • <br /> • <br /> ORDINANCE No. <br /> AN ORDINANCE amending Section 38 of Ordinance No. 2734 <br /> of the City of Everett, entitled es follows: <br /> "AN ORDINANCE relating to vehicles and the operation <br /> thereof upon the public streets andother public places <br /> of the City of Everett; providing for vehicle equipment ; <br /> limiting and restricting certain sections of the public <br /> streets andother -Public places of the City of Everett ; <br /> prescribing rules of the road for vehicles operating on <br /> public streets or other public places of the City of <br /> Everett; defining offenses and fi xing penalties; repeal- <br /> ing certain ordinances and parts of ordinances in con- <br /> flict with the provisions of this ordinance; saving <br /> certain acts perforrred and declaring an emergency," <br /> and declaring an emergency . <br /> T`=t; CITY OF E METT DOES ORDAIN: <br /> Section 1: That Section 38 of Ordinance No. 2734 <br /> of the City of Everett, entitled as above set forth, be , and <br /> the same is hereby amended to read as follows: <br /> Section 38: Any person violating the provisions <br /> of Section 28 of this ordinance of operating any vehicle upon <br /> the public highways or alleys of the City of Everett while <br /> under the influence of , or affected by the use of any intoxicat- <br /> ing liquor or of any narcotic drug shall , upon the first <br /> conviction, be punished by a fine of not less than '>50 .00 or <br /> more than 300 .00 , or by imprisonment for not less than Ten (10 ) <br /> days or more than Ninety ( 90) days in the City Jail, or by both <br /> such fine and imprisonment. <br /> Any person violating the provisions of Section 28 of <br /> this ordinance of operating any vehicle upon the public highways <br /> or alleys of the City of Everett while under the influence of , <br /> or affected by the use of any intoxicating liquor or of any <br /> narcotic drug shall, upon a second or subsequent conviction, <br /> be punished by a fine of not less than 1100.00 or more than <br /> 300.00 , or by imprisonment for not less than Thirty (30 ) days <br /> or more than Ninety (90) days in the City Jail, or by both such <br /> fine and imprisonment. <br /> In addition to the above , upon any of such convictions <br /> the operator's license of such. person shall be revoked. <br /> Any person violating any of the other provisions of <br /> this ordinance shall upon conviction be puni shed by a fine in an <br /> sum not exceeding 300 .00 , or by Timprisonment in the Cit <br /> jailh in <br /> for a period not exceeding Ninety (90 ) days, or by bo <br /> thand imprisonment. <br />
