7 <br /> 4 <br /> ORDINArCE No. <br /> 0 . <br /> AN ORDINMTOE prov i di ng for the improvement of the West <br /> side of Oakes Avenue from 10th Street South to Athletic Field <br /> by construction of concrete sidewalks, installation of necessary <br /> drainage , and doing all work necessary to rake a complete <br /> improvement; creating an assessment district ; creating a local <br /> improvement district fund therefor; providing that the payment <br /> of said improvement be made by special assessment on the property <br /> in said district under the mode of payment by bonds for materials <br /> used , fixed estimate and all other expenses, except cost of labor <br /> furnished by federal funds under W .P.A. plan of the Federal <br /> Government . <br /> WEEREAS, a majority petition of the property owners <br /> petitioning for said improvement has heretofore been filed with <br /> the City Council and upon examination thereof the said City <br /> Council has found the things set forth therein to be true; and <br /> WEEREAS, the said petition has been referred to the <br /> Commissioner of Public Works to be examined by the said Commission- <br /> er and the City EngeerOunileallr1 datalandr of l'ublic informationasWorks <br /> has filed with the City C c <br /> required by law; and <br /> WEEREAS, said Commissioner of Public Works has recommended <br /> to the City Council that said improvement petitioned for be made,' <br /> and it appearing to the City Council that the public health, <br /> convenience and necessity require that such improvement be made . <br /> NOW, THEREFORE, the City of Everett DOES ORDAIN: <br /> Section 1: That the West side of Oakes Avenue from <br /> 10th Street South to Athletic Field be improved by construction <br /> of concrete sidewalks, installation of necessary drainage, and <br /> doing all work necessary to make a complete improvement , all <br /> according to the plans and specifications prepared under the <br /> direction of the City Engineer, which plans and specifications <br /> are hereby adopted and approved. <br /> Section 2: That the cost and expense of all materi l s <br /> required to make a complete improveme , the <br /> hcostf fixed <br /> eof daestimate or over nandt d <br /> all other expenses of every kind , ett <br /> by the federal government under W.P.A. , shall be borne by and <br /> assessed against the property included in the assessmentssty of Everett <br /> dis- <br /> trict herein created in accordance with law. <br /> The shall not be liable in any manner far the cost and expense of <br /> such improvement, except as provided in Chapter 141, Session <br /> Laws of 1923, or acts amendatory thereto, and the ordinances of <br /> the City of Everett. <br /> Section 3: <br /> There is hereby established a local <br /> improvement district to be called Local Improvement District <br /> No. S5- 4 , which district shall include the following <br /> described property, located in Everett , Snohomish County, <br /> Washington, to-wit : <br />
