AN ORDINMTOE prov i di ng for the improvement of the West side of Oakes Avenue from 10th Street South to Athletic Field by construction of concrete sidewalks, installation of necessary drainage , and doing all work necessary to rake a complete improvement; creating an assessment district ; creating a local improvement district fund therefor; providing that the payment of said improvement be made by special assessment on the property in said district under the mode of payment by bonds for materials used , fixed estimate and all other expenses, except cost of labor furnished by federal funds under W .P.A. plan of the Federal Government . WEEREAS, a majority petition of the property owners petitioning for said improvement has heretofore been filed with the City Council and upon examination thereof the said City Council has found the things set forth therein to be true; and WEEREAS, the said petition has been referred to the Commissioner of Public Works to be examined by the said Commission- er and the City EngeerOunileallr1 datalandr of l'ublic informationasWorks has filed with the City C c required by law; and WEEREAS, said Commissioner of Public Works has recommended to the City Council that said improvement petitioned for be made,' and it appearing to the City Council that the public health, convenience and necessity require that such improvement be made . NOW, THEREFORE, the City of Everett DOES ORDAIN: Section 1: That the West side of Oakes Avenue from 10th Street South to Athletic Field be improved by construction of concrete sidewalks, installation of necessary drainage, and doing all work necessary to make a complete improvement , all according to the plans and specifications prepared under the direction of the City Engineer, which plans and specifications are hereby adopted and approved. Section 2: That the cost and expense of all materi l s required to make a complete improveme , the hcostf fixed eof daestimate or over nandt d all other expenses of every kind , ett by the federal government under W.P.A. , shall be borne by and assessed against the property included in the assessmentssty of Everett dis- trict herein created in accordance with law. The shall not be liable in any manner far the cost and expense of such improvement, except as provided in Chapter 141, Session Laws of 1923, or acts amendatory thereto, and the ordinances of the City of Everett. Section 3: There is hereby established a local improvement district to be called Local Improvement District No. S5- 4 , which district shall include the following described property, located in Everett , Snohomish County, Washington, to-wit :
