I <br /> 1 1-06.OPT2.GR1 <br /> I <br /> 2 Build America/Buy America <br /> 3 <br /> 4 1-06.OPT2(A).GR1 <br /> I <br /> 5 (October 5, 2022) <br /> 6 General Requirements <br /> 7 In accordance with Division G, Title IX- Build America, Buy America Act(BABA), of Public <br /> I 8 Law 117-58 (Infrastructure Investment and Jobs Act), the following materials must be <br /> 9 American-made: <br /> 10 <br /> Iii 12 1. All steel and iron used in the project are produced in the United States. This <br /> means all manufacturing processes, from the initial melting stage through the <br /> 13 application of coatings, occurred in the United States. <br /> I 14 <br /> 15 2. All manufactured products used in the project are produced in the United States. <br /> 16 This means the manufactured product was manufactured in the United States, <br /> I <br /> 17 and the cost of the components of the manufactured product that are mined, <br /> 18 produced, or manufactured in the United States is greater than 55 percent of the <br /> 19 total cost of all components of the manufactured product, unless another <br /> 20 standard for determining the minimum amount of domestic content of the <br /> I <br /> 21 manufactured product has been established under applicable law or regulation. <br /> 22 <br /> 23 3. All construction materials are manufactured in the United States. This means <br /> I 24 that all manufacturing processes for the construction material occurred in the <br /> 25 United States. <br /> 26 <br /> 111 <br /> 27 28 An article, material, or supply will be classified in one of three categories: 1) Steel and <br /> Iron, 2) Manufactured Product or 3) Construction Material. Only a single category will <br /> 29 apply to an item and be subject to the requirements of the BABA requirements of that <br /> I 30 category. Some contract items are composed of multiple parts that may fall into different <br /> 31 categories. Individual components will be categorized as a construction material, <br /> 32 manufactured product, or steel and iron based on their composition when they arrive at <br /> 33 the staging area or work site. <br /> I34 <br /> 35 Definitions <br /> 36 1. Construction material: Defined as any article, material, or supply brought to the <br /> I37 construction site for incorporation into the final product. Construction materials <br /> 38 include an article, material, or supply that is or consists primarily of: <br /> 39 <br /> I 40 a. Non-ferrous metals; <br /> 41 <br /> 42 b. Plastic and polymer-based products (including polyvinylchloride, composite <br /> I 43 building materials, and polymers used in fiber optic cables); <br /> 44 <br /> 45 c. Glass (including optic glass); <br /> I 46 <br /> 47 d. Lumber; or <br /> 48 <br /> I <br /> 49 e.
