I 1 2 a. Covered Area means the geographical area described in the solicitation 1 3 from which this contract resulted; 4 5 b. Director means Director, Office of Federal Contract Compliance Programs, I 6 United States Department of Labor, or any person to whom the Director 7 delegates authority; 8 9 c. Employer Identification Number means the Federal Social Security number 10 used on the Employer's Quarterly Federal Tax Return, U. S. Treasury 11 Department Form 941; 12 13 d. Minority includes: 14 I 15 (1) Black, a person having origins in any of the Black Racial Groups 16 of Africa. 17 18 (2) Hispanic, a fluent Spanish speaking, Spanish surnamed person of I 19 Mexican, Puerto Rican, Cuban, Central American, South 20 American, or other Spanish origin. 21 1 22 (3) Asian or Pacific Islander, a person having origins in any of the 23 original peoples of the Pacific rim or the Pacific Islands, the 24 Hawaiian Islands and Samoa. 25 26 (4) American Indian or Alaskan Native, a person having origins in any 27 of the original peoples of North America, and who maintain cultural 28 identification through tribal affiliation or community recognition. 29 30 2. Whenever the Contractor, or any subcontractor at any tier, subcontracts a portion of 1 31 the work involving any construction trade, it shall physically include in each 32 subcontract in excess of $10,000 the provisions of these specifications and the 33 Notice which contains the applicable goals for minority and female participation and 34 which is set forth in the solicitations from which this contract resulted. 35 36 3. If the Contractor is participating (pursuant to 41 CFR 60-4.5) in a Hometown Plan 37 approved by the U.S. Department of Labor in the covered area either individually or I 38 through an association, its affirmative action obligations on all work in the Plan area 39 (including goals and timetables)shall be in accordance with that Plan for those trades 40 which have unions participating in the Plan. Contractors must be able to demonstrate 41 their participation in and compliance with the provisions of any such Hometown Plan. 42 Each Contractor or subcontractor participating in an approved Plan is individually 43 required to comply with its obligations under the EEO clause, and to make a good 44 faith effort to achieve each goal under the Plan in each trade in which it has 45 employees. The overall good faith performance by other Contractors or 46 subcontractors toward a goal in an approved Plan does not excuse any covered , 47 Contractor's or subcontractor's failure to take good faith effort to achieve the Plan 48 goals and timetables. 49 50 4. The Contractor shall implement the specific affirmative action standards provided in 51 paragraphs 7a through 7p of this Special Provision.
