ORDAIi NCE No. AN ORDIN.ENCE providing for the improvement of Roc'-e- feller ::venue between 10th end llth Streets, by grading to proper grade , construction of concrete sidewalk, installation of curbs and gutters, installation of necessary drainage and doing all work necessary to make a complete improvement ; creating an assessment district ; creating a local improvement district fund therefor; providing that the payment of said improvement be made by special assessment on the property in said district under the mode of payment by bonds for materiels used, fixed estimate and all other expenses, except cost of labor furnished by federal fun' s under EPA plan of the Federal Government . HERE S , a majority petition of the property owners petitioning for said improvement has heretofore been filed with the City Council and upon examination thereof the said City Council has found the things set forth therein to be true ; and WHEREAS, the said petition has been referred to the Commissioner of Public Works to be examined by the said Commissioner and the City Engineer and the Commissioner of Public Works has filed with the City Council all data and information as required by law; and WHEREAS, said Commissioner of public Works ha s recommended to the City Council that said improvement petitioned for be made , and it appearing to the Uity Council that the public health, convenience and necessity require that such improvement be made . NOW, TFEREFORE, the City of Everett DOES ORDAIN: Section 1: That Rockefeller . venue between 10th end llth Streets be improved by grading to proper grade , con- struction of concrete sidewalk, installation of curbs and gutter , installation of necessary drainage and doing ell work necessary to make a complete improvement, all according to the plans and specifications prepared under the direction of the City Engineer, which plans and specifications are hereby adopted and approved. Section 2: That the cost and expense of all materials required to make a complete improvement, the fixed estimate and all other expenses of every kind, except cost of labor contributed by the Federal Government under -.IPA, shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for the cost andv expense of such improvement , except as provided in Chapter 14.1 , Session Laws of 1923, or acts amendatory thereto and the ordinances of the City of Everett. Section 3: There is hereby established a local improvement district to be celled 'Local improvement District No. �'�y- , which district shall include the following described property, located in Everett , Snohomish County , ''a shington, to-wit :
