• <br /> ORDINMCE No. <br /> AY ORDINANCE providing for the improvement of lioyt <br /> Avenue from 44th Street to 45th Street, also 45th Street <br /> from Hoyt Avenue to Central Avenue and 44th Street , end also <br /> Central Avenue from 45th Street to 48th Street by the installa- <br /> tion of Six inch water and :ire Hydrants and their necessary <br /> a; purtenances, end doing all other work necessary to make a <br /> complete improvement ; creating an assessment district ; creating <br /> a local improvement district fund therefor; providing that the <br /> payment of said improvement be mode by special assessment on the <br /> property in said district under the mode of payment by bonds <br /> for materials used, fixed estimate End all other expenses, <br /> except cost of labor furnished by federal funds under PA plan <br /> of the Federal Government . <br /> WHEREAS, a majority petition of the Property owners <br /> petitioning for said improvement has heretofore been filed <br /> with the city Council and upon examination thereof the said <br /> City Council has found the things set forth therein to be true; <br /> and <br /> F-EREES, the said petition has been referred to the <br /> Commissioner of rublic yyorks to be examined by the said <br /> Commissioner and the City Engineer and the Commissioner of rublic <br /> Works has filed with the City Council all data and information <br /> as required by law; and <br /> :REAS, said Comr issionD r of Public • orks has <br /> recommended to the City Council that said improvement petitioned <br /> for be made , and it appearing to the City council that the <br /> public health, convenience and necessity require that such <br /> improvement be made . <br /> NOW, THEREFORE, the City of Everett does ORDAIN: <br /> Section 1: That hhoyt Avenue from 44th Street to <br /> 45th Street, also 45th Street from rioyt ivenue to Central <br /> Avenue and 44th Street , and also Central Avenue from 45th Street <br /> to 48th Stree ,Dy installation of :six inch water mains and <br /> fire hydrants and their necessary appurtenances, and doing all <br /> other work necessary to make a complete improvement, all accord- <br /> ing to the plans and specifications prepared under the direction <br /> of the City Engineer, which plans and specifications are hereby <br /> adopted and approved. <br /> Section 2: That the cost and expense of all <br /> materials required to make a complete improvement , the fixed <br /> estimate and all other expenses of every kind, except cost of <br /> labor contributed by the Federal Government under T , shall <br /> be borne by and assessed against the property included in the <br /> assessment district herein created in accordance with law. The <br /> City of .Everett shall not be liable in any manner for the <br /> cost and expense of such improvement , except as provided in <br /> Chapter 141, Session Laws of 1923, or acts amendatory thereto <br /> and the ordinances of the City of __verett. <br />
