Section 7 : No person shall construct or install, <br /> without a written permit, from the Health Officer of the 'ity of <br /> Everett any Privy, vault or septic tank, and provided no permit <br /> shall be granted to install any privy or privy vault within <br /> Twenty (20) feet of anyresidence or auilding in which perishable <br /> food is kept or stored, nor within Six ( 6) feet of the boundary <br /> line of theprerslises on which it is built . <br /> Section 8: =-o person shell permit any flush toilet <br /> or other means of disposal of human excreta , uvon premises <br /> owned or occupied by him, to be in any manner connected with, <br /> or to discharge or flow into any storm sewer within the City of <br /> Everett. <br /> Section 9: imy privy or private sewer existing or <br /> being maintained which does not conform to the requirements of <br /> this ordinance , shell be , and is hereby declared a nuisance, <br /> dangerous, and a menace to the _public health , and the City of <br /> Everett, Washington, shell have the power and authority to abate <br /> any such nuisance in accordance with law. <br /> Section 10 : It shall be the duty of the City Health <br /> Officer to enforce the provisions of this ordinance , and in the <br /> performance of this duty the Health Officer or his duly <br /> authorized agent is hereby authorized to enter at any time any <br /> premises as may be necessary in the enforcement of this ordinance. <br /> Section 11 : Any person, firm or corporation who violates <br /> or refuses or fails to comply with any of the provisions of this <br /> ordinance shall be guilty of a misdemeanor and shall be punished <br /> by a fine of not less t he n Twenty-five Dollars U25.00) nor more <br /> than One Hundred Dollars ( 100.00 ) . <br /> Section 12 : Every person, firm or corporation shall <br /> be deemed guilty of a separate offense for every day during any <br /> portion of which any violation of any provision of this ordinance <br /> is committed, continued or permitted by such person, firil or <br /> corporation, and shall be punishable therefor as provided by this <br /> ordinance. <br /> Section 13: If any section, sub-section, sentence , <br /> clause or phrase of this ordinance is for any reason held to be <br /> invalid or unconstitutional, such decision shall not affect the <br /> validity of the remaining Portions of this ordina ce . The Council <br /> of the City of Everett hereby declar1s that it would have passed <br /> this ordinance, and each section, sub-section, sentence , clause <br /> and phrase thereof, irrespective of the fact that any one or more <br /> other sections, sub-sections, sentences, clauses or phrases be <br /> declared invalid or unconstitutional. <br /> Section 14: Sections 12 to 18 inclusive of Ordinance <br /> No. 1589, Section 36 of Ordinance No. 1229 and all other <br /> ordinances in conflict with this ordinance are hereby repealed. <br /> Section 15 : An emergency is hereby declared to exist & thi <br /> prdinance shal,L take effect upon its passage and publication . <br /> Attest: Mayor <br /> City Clerk <br /> �lG;yam, <br /> Passed: January 30 , 1940 <br /> Published: Jan. 31 , (. <br />
