x� <br />Date:3/4/202012:54 PM Snohomish County, WA <br />NOW, TBEREFORE, for good and valuable consideration, the receipt and. sufficiency <br />of which is hereby acknowledged by the parties, the parties each agree as follows: <br />1. Easement Area. Grantor hereby grants and conveys a non-exclusive <br />easement under, through and upon that portion of the Burdened. Property which is legally <br />described in Exhibit "C", attached hereto (the "Easement. Area") for the benefit of the <br />Benefited Property. <br />2. Sc_ of Use of Easement Area. The Easement Area shall be used to allow <br />the installation and maintenance of an underground drainage line- from the Benefited Property <br />to the city storm drain located along T ulalip Avenue for the benefit of the Benefited Property <br />and its owners. <br />3. Duration. This Easement shall be of perpetual duration. <br />4. Easement Runs with the Land. This Easement shall run with the land and <br />shall be binding upon the owners of the Burdened Property and the Benefited Property and <br />each of their heirs, successors and assigns, forever, as if each of the properties' future owners <br />were the parties to this Agreement. Except for signing purposes, the term "Grantor" shall <br />also include all future owners of interest in the Burdened Property, and the term "Grantee" <br />shall also include all future owners of interest in the Benefited Property. <br />5. , Use of Easement Area bGrantor. The Grantor may use the Easement <br />Area for any and all purposes not inconsistent with the provisions of this Easement. <br />6. Repair and Maintenance of Improvements. The maintenance of the <br />Easement and the drainage line, including restoration of the surface, shall be the responsibility <br />of and the costs thereof borne by the present and future owners of the Benefited Property: <br />7. Breach. In the event of any breach or threatened breach of this Easement by <br />the owner of either the Burdened Property or the Benefited Property, the non -defaulting <br />owner shall have the right to sue for damages and/or for specific performance and/or to enjoin <br />such breach or threatened breach and/or to lien the defaulting owner's property as set forth <br />herein. <br />8. No Termination Upon Breach. No breach of this Easement shall entitle <br />either owner to cancel, rescind or otherwise terminate this Easement; provided, however, that <br />this provision shall not' limit or otherwise affect any other right or remedy which an owner <br />may have hereunder by reason of any breach of this Easement. <br />9. ;Governine Law: This Easement shall be governed by and construed in <br />accordance with the laws of the State of Washington. <br />DECLARATION OF EASEMENT - 2 <br />
