FIRST AMENDMENT <br />TO <br />LICENSE TO USE CITY PROPERTY <br /> <br /> This First Amendment to License to Use City Property is dated for reference <br />purposes May 1, 2023. It is by and between the City of Everett, a municipal corporation <br />under the laws of the State of Washington (“City”), and Hydrology Stand Up Paddle <br />(“Hydrology”). <br /> <br />RECITALS <br /> <br />A. The City and Hydrology are parties to the License to Use City Property <br />dated on or about May 5, 2021 (the “License”). The License had an initial one-year term <br />from May 15, 2021, to May 14, 2022. <br /> <br />B. During the following one-year period from May 15, 2022, to May 14, 2023, <br />the City and Hydrology performed under the License, and Hydrology paid License rental <br />payments. However, the City and Hydrology cannot locate the executed amendment <br />formally extending the License for that time period. Accordingly, one purpose of this First <br />Amendment is to confirm that the License was in effect from May 15, 2022, to May 14, <br />2023. <br /> <br /> C. The City and Hydrology also desire to further extend the License for <br />another year, which will cover the time period from May 15, 2023, to May 14, 2024. <br /> <br />AGREEMENT <br /> <br />The City and Hydrology agree as follows: <br /> <br />1. The parties confirm that the License is deemed extended and was in effect from May <br />15, 2022, to May 14, 2023. Hydrology has already paid rental payments for that <br />time period in the total amount of $1440. However, the payments should have <br />included a CPI increase for a total amount of $1556.64. Hydrology will pay the <br />outstanding balance ($116.64) within 30 days after the mutual execution of this <br />First Amendment. <br /> <br />2. The License is further extended for another year, for the time period from May <br />15, 2023, to May 14, 2024. During that time period, Hydrology shall pay the City <br />a monthly rental payment of $388.80 for June, July, and August and a prorated <br />amount of $194.40 per month for the partial months of May and September. <br /> <br />3. This First Amendment may be signed in counterparts, each of which shall be deemed <br />an original, and all of which, taken together, shall be deemed one and the same <br />document. Execution of this Amendment by a party shall be legally valid and <br />effective by (i) executing a paper copy, (ii) execution by AdobeSign or DocuSign or
