1 <br /> • <br /> ORDINANCE No.2823. <br /> ;TT ORDINANCE providing for the improvement of Grand Avenue <br /> from 34th Street to 35th Street by necessary grading and surfacing <br /> with Three inch road mix, construction of concrete curbs and <br /> gutters, construction of sidewalks on both sides of said street, <br /> installation of necessary drainage , and doing all other work <br /> necessary to make a complete improvement; creating an assessment <br /> district; creating a local improvement district fund therefor; <br /> providing that the payment of said improvement be mode by <br /> special assessment on the property in said district under the <br /> mode of payment by bonds for materials used, fixed estimate and <br /> all other expenses , except cost of labor furnished by federal <br /> funds under WPA. plan of the Federal Government . <br /> �P WEB'{S, a majority petition of the property owners <br /> petitioning for said improvement has heretofore been filed with <br /> the City Council, and upon examination thereof the said City <br /> Council has lout(' the things set forth therein to be true ; and <br /> WHEREAS, the said petition has been referred to the <br /> Colmissioner of Public Works to be examined by the said <br /> Commissioner and the City Engineer, and the Commissioner of <br /> Public "Works has filed with the City Council all data and <br /> information as required by law; and <br /> WIIERE2,S, said Commissioner of Fublic Works has <br /> recommended to the City Council that said improvement petitioned <br /> for be made, and it appearing to the City Council that the <br /> public health, convenience and necessity require that said <br /> improvement be made . <br /> NOW, THEREFORE, the City of Everett does ordain: <br /> Section 1: . That Grand Avenue from34th Street to <br /> 35th Street be improved by necessary grading andsurfacing with <br /> Three inch road mix, construction of concrete curbs and gutters, <br /> construction of sidewalks on both sides of said Street, <br /> installation of necessary drainage, and doing all other work <br /> necessary to make as complete improvement , all according to the <br /> plans and specifications prepared under the direction of the <br /> City Engineer, which plans and specifications are hereby <br /> adopted and ap _,roved. <br /> Section 2 : That the cost and expense of all <br /> materials required to make a complete improvement , the fixed <br /> estimate and all other expenses of every kind, except cost of <br /> labor contributed by the Federal Government under WP^. , shell <br /> be borne by and assessed against the property included in the <br /> assessment district herein created in accordance with law. <br /> The City of Everett shall not be liable in any manner for the <br /> cost and expense of such improvement , except as provided in <br /> Chapter 141 Session Laws of 1923, or acts amendatory thereto, <br /> and the ordinances of the City of Everett. <br />
