J 1 4 f ORDINANCE No. 7/0, AN ORDINANCE providing for the improvement of Thirty- fifth Street from West en, of pavement East of Nassau Street to Snohomish Avenue , by necessary gxading and surfacing with Three inch road ��_ix, construction of concrete curbs and gutters, construction of sidewalks on the North side , installation of necessary drainage, and doing all other work necessary to make a complete improvement ; creating; an assessment district ; creating e local improvement district fund therefor; providing that the payment of said improvement be made by special assessment on the property in said district under the mode of payment by bonds for materiels used, fixed estimate and all other expenses, except cost of labor furnished by federal funds under ';PA. plan of the Federal Government. WHEREAS, a majority petition of the property owners petitioning for said improvement has heretofore been filed with the City Council, and upon examination thereof the said City Council has found the things set forth therein to be true ; and WHEREAS, the said petition has been referred to the Commissioner of Public .corks to be examined by the said Commissioner and the City Engineer, and the Commissioner of Publi Works has filed with the City Council all data and information as required by law; and WHEREAS, said Commissioner of .I'uolic orks has recomended to the City Council that said improvement petitioned for be made , and it appearing to the City Council that the public health, convenience and necessity rewire that said improvement be made. N01J, `T`yREFORE, the City of Everett does ORDAIN: Section 1: That Thirty-fifth Street from West end of pavement East of Nassau Street to Snohomish Avenue be improved by necessary grading and surfacing with Three inch road mix, construction of concrete curbs and gutters, construction of sidewalks on the North side, installation of necessary drainage, and doing all work necessary to make a complete improvement, all according to the plans and specificatio' s prepared under the direction of the City Engineer, which plans and specifications are hereby adopted and approved. Section 2 : That the cost and expense of all materials required to make a complete improvement , the fixed estimate and all other expenses of every trod, except cost of labor contributed by the Federal Government under " ':,, shall be borne by and assessed. against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for the cost and expense of such improvement , except as provided in Chapter 141 Session Laws of 1923, or acts amendatory thereto, and the ordinances of the City of Everett.
