The County Commissioners of Snohomish County to maintain street <br /> railway tracks and to operate street cars thereover and to maintain <br /> and operate an electric interurban railway upon any of the streets, <br /> avenues or other public places within said city, and in particular <br /> does hereby fully release said company from the obligation to re- <br /> move said tracks upon abandonment of street railway and interur- <br /> ban operations and to repave the streets after such track removal. <br /> Without limiting the generality of the foregoing the follow- <br /> ing franchises are specifically referred to: <br /> Franchise granted to Edward P. ?lurch by Ordinance No. <br /> 252 of the City of Everett, passed on December 3, 1900, <br /> as amended by Ordinance No. 2037 passed on August 15, <br /> 1922; <br /> Franchise granted to Pacific Northwest Traction Company <br /> by Ordinance No. 2036, passed on August 15, 1922. <br /> It is understood that this release shall extend to and be for <br /> the benefit of Puget Sound Power & Light Company, as well as North <br /> Coast Transportation Company, and also all of the predecessors in <br /> interest and the successors and assigns of each thereof, including <br /> Everett Bus System, Inc., as the present holder of the franchise <br /> granted by Ordinance No. 2037; provided, however, it is further <br /> understood that all rights granted by said Ordinance No. 2037 here- <br /> tofore transferred to Everett Bus System, Inc., shall remain unaffected <br /> by this release, except, as above stated, that upon payment of said <br /> sum by North Coast Transportation Company said Everett Bus System, <br /> Inc. shall likewise be deemed fully released from the obligation to <br /> remove tracks upon abandonment of street railway operations and to <br /> repave the streets after such track removal. <br /> CITY OF EVERETT <br /> Attest: By <br /> Mayor <br /> City Clerk <br /> Section 4. That all rights under Ordinance No. 2037, heretofore trans- <br /> ferred to Everett Bus System, Inc., shall remain unaffected by anything <br /> contained in this Ordinance, except that the holder of said franchise, and <br /> its successors and assigns, shall be deemed fully released, upon payment <br /> of said sum of $18,9 63.49 by North Coast Transportation Company, from the <br /> obligation to remove said ,Rtreet railway tracks upon abandonment of street <br /> railway and interurban operations and to repave the streets after such <br /> track removal. <br /> Section 5. An emergency is declared to exist, and this ordinance <br /> shall take effect upon its passage and publication. <br /> - 4 - <br />
