I <br /> City of Everett 00 7200 -44 <br /> I <br /> 12.2 CONTENTS <br /> All Contract Claims filed by the Contractor shall be in writing,verified under penalty of perjury by an I <br /> officer or principal of the Contractor,and in sufficient detail to enable the Owner's Representative to <br /> ascertain the basis and amount of the Contract Claim.All Contract Claims shall be submitted to the <br /> Owner's Representative. At a minimum,each Contract Claim must include: <br /> 1. A detailed factual statement of the Contract Claim for additional compensation and extension of <br /> Contract Time,if any,providing all necessary dates, locations,and items of work affected by the <br /> Contract Claim. I <br /> 2. The dates of all facts related to the Contract Claim. <br /> 3. The name of each Owner's individual,official,or employee involved in or knowledgeable about <br /> the Contract Claim. <br /> 4. The specific provisions of the Contract that support the Contract Claim and a statement of the <br /> reasons why such provisions support the Contract Claim. <br /> 5. If the Contract Claim relates to a decision of the Owner's Representative that the Contract leaves <br /> to the Owner's Representative's discretion or as to which the Contract provides that the Owner <br /> Representative's decision is final,the Contractor shall set out in detail all facts supporting its <br /> position relating to the decision of the Owner's Representative. <br /> 6. Identification of any documents and the substance of any oral communications that support the <br /> Contract Claim. <br /> 7. Copies of any identified documents that support the Contract Claim,other than Owner documents <br /> and documents previously furnished to the Owner by the Contractor. Standard industry manuals <br /> may be incorporated by reference. <br /> 8. If Contractor seeks an extension of Contract Time: <br /> a. The specific amount of time(including days and dates) sought. <br /> b. The specific reasons the Contractor believes an extension of Contract Time should be 111 <br /> granted,including,but not limited to,compliance with the requirements of 5.2.2.2 <br /> Extensions of Contract Time;and <br /> c. The specific provisions of the Contract Documents under which it is sought. <br /> 9. If additional compensation is sought,the exact amount sought and a breakdown of that amount <br /> into the following categories: <br /> a. Labor <br /> b. Materials <br /> c. Direct Equipment. The actual cost for each piece of equipment for which a Contract Claim is <br /> made or in the absence of actual cost,the rates established by the AGC/WSDOT Equipment <br /> Rental Agreement that was in effect when the work was performed.In no case shall the <br /> amounts sought or paid for each piece of equipment exceed the rates established by the <br /> Equipment Rental Agreement even if the actual cost for such equipment is higher. The <br /> Owner may audit the Contractor's cost records to determine actual equipment cost. The <br /> following information shall be provided for each piece of equipment: I <br /> i. Detailed description (e.g., Motor Grader Diesel Powered Caterpillar 12 "G", Tractor <br /> Crawler ROPS &Dozer Included Diesel) <br /> ii. The hours of use or standby; and I <br /> iii. The specific day and dates of use or standby; <br /> iv. Job Overhead. I <br /> 00 7200 - 44 GENERAL CONDITIONS <br />
