SECTION 00 50 00 STANDARD FORM OF AGREEMENT MODIFIED AIA DOCUMENT A133— 2019 STANDARD FORM OF AGREEMENT BETWEEN OWNER AND CONSTRUCTION MANAGER AS CONSTRUCTOR THIS DOCUMENT WAS PROVIDED AS PART OF THE ORIGINAL RFP AND IS UNCHANGED, EXCEPT AS NOTED BELOW. REFER TO RFP 2022-101 Add the red underlined sentence to Section 5.1.1 of the A133: Total compensation for the Preconstruction Services (the "Preconstruction Services Cost") shall not exceed $ , which includes $ in sales tax. Preconstruction Services Cost subject to this not-to-exceed amount includes without limitation payment on an hourly basis at the rates and for the individuals specified in Exhibit 2 to this Agreement, payment for equipment at the hourly rates specified in Exhibit 2, and payment for other additional costs when preapproved in writing (which may include but are not limited to costs of testing, intrusive, or non-intrusive investigation, selective demolition and restoration, copying, blueprints and courier costs). All Preconstruction Services rates include personnel and consultant costs and all benefits, materials, equipment, taxes, profit and overhead. The Construction Manager shall not be reimbursed for costs to prepare for and conduct MACC and GMP Amendment negotiations. Costs that would cause the not-to-exceed amount to be exceeded shall be paid by the Construction Manager without reimbursement by the Owner. The Construction Manager's Fee in Section 6.1.2 does not apply to Preconstruction Services, and any savings from any not-to- exceed amount for Preconstruction Services will revert to the Owner.
