SECTION 00 50 00 <br /> STANDARD FORM OF AGREEMENT <br /> MODIFIED AIA DOCUMENT A133— 2019 <br /> STANDARD FORM OF AGREEMENT BETWEEN <br /> OWNER AND CONSTRUCTION MANAGER AS <br /> CONSTRUCTOR <br /> THIS DOCUMENT WAS PROVIDED AS PART OF <br /> THE ORIGINAL RFP AND IS UNCHANGED, <br /> EXCEPT AS NOTED BELOW. <br /> REFER TO RFP 2022-101 <br /> Add the red underlined sentence to Section 5.1.1 of the A133: <br /> Total compensation for the Preconstruction Services (the "Preconstruction Services Cost") shall <br /> not exceed $ , which includes $ in sales tax. Preconstruction <br /> Services Cost subject to this not-to-exceed amount includes without limitation payment on an <br /> hourly basis at the rates and for the individuals specified in Exhibit 2 to this Agreement, payment <br /> for equipment at the hourly rates specified in Exhibit 2, and payment for other additional costs <br /> when preapproved in writing (which may include but are not limited to costs of testing, intrusive, <br /> or non-intrusive investigation, selective demolition and restoration, copying, blueprints and courier <br /> costs). All Preconstruction Services rates include personnel and consultant costs and all benefits, <br /> materials, equipment, taxes, profit and overhead. The Construction Manager shall not be <br /> reimbursed for costs to prepare for and conduct MACC and GMP Amendment <br /> negotiations. Costs that would cause the not-to-exceed amount to be exceeded shall be paid by <br /> the Construction Manager without reimbursement by the Owner.
