• • ORDINANCE No. 2788. AN ORDINANCE providing for the inprovenent of Twenty- third Street from Colby :;venue to Summit avenue , by grading to proper grade , construction of Portland cement concrete pavement, construction of concrete curbs, repair sidewalks as necessary, installation of necessary drainage and doing all other work necessary to make a complete improvement, all in accordance with Resolution No. 4433 of the City of Everett ; creating an assess- ment district; creating a local improvement district fund there- for; providing that the cost of the improvement , not to exceed Fifty-five percent ( 55)/0) , plus the fixed estimate, be paid by special assessment upon the property in said district under the m.de of payment by bonds, and the balance thereof shall be paid from funds allocated to the City of Everett by federal grant of the United States Government under P7;'1".; WHEREAS, by Resolution No. 4433 of the City of Everett the City Council has declared its intention to order the improve- ment as above outlined, and doing all other work necessary to make a complete improvement , in accordance with the plans and specifications prepared by the City Engineer of the City of Everett. NO , TIC+ ?EF ORE , THE CITY OF EVER ETT DUES S ORDAIN: Section 1: That Twenty-third Street from Colby Avenue to Summit Avenye be improved by grading to proper grade, construction of Portland cement concrete pavement , construction of concrete curbs, repairing sidewalks as necessary, installa- tion of necessary drainage, and doing all other work necessary to make a complete improvement, all according to the plans and specifications prepared under the direction of the City Engineer, which plans and specifications are hereby adopted and approved. Section 2 : A sun not to exceed fifty-five Percent (55 ) of the cost and expense of such improvement, plus fixed estimate , shall be borne by and assessed against the property included in the assessment district , herein created in accordant: with law. The balance of the cost thereof shall be paid by funds allocated to the City of Everett by federal grant of the United States Government under P'r,A . The City of Everett shall not be liable in any manner for any portion of the cost and expense of such improvement, except as provided in Chapter 141, Session Laws of -Jashington of 1923, and acts amendatory thereto , and the ordinances of said City. Section 3: There is hereby established a local improvement district to be called "Local Improvement District No. 532- . which district shall include all the following described property, to-wit:
