t r I . ORDINANCE NO. 2736. AN ORDINANCE providing for the improvement of Friday Avenue from 39th Street to 41st Street by necessary grading and surfacing with three inch road mix and other work necessary to make a complete improvement , creating an assessment district, creating a local improvement district fund therdbr providing that the payment for said improvement be made by special assessment on the property in said district under the mode of payment by bonds for materials used, fixed estimate and all other expenses, except costs of labor furnished by federal funds under WPA plan of the Federal Government. WHEREAS, a majority petition of the property owners petitioning for said improvement has heretofore been filed with the City Council and upon examination thereof the said City Council has found the things set forth therein to be true ; and WHEREAS, the said petition has been referred to the Commissioner of Public Works to be examined by the said Commissiqnez and the City Engineer and the Commissioner of Public 7Iorks has filed with the City Council all data and information as required by law; and W EREAS, said Commissioner of Public Works has recommended to the City Council that said improvement petitioned for be made and it appearing to the City Council that the public health, convenience and necessity require that such improvement be made. NOW THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That Friday Avenue from 39th Street to 41st Street be improved by necessary grading and surfacing with three inch road mix and other work necessary to make a complete improvement in accordance with the plans and specifica- tions prepared under direction of the City Engineer, which plans and specifications are hereby adopted and approved. Section 2: That the cost and expense of all materials required to make a complete improvement , the fixed estimate and all other expenses of every kind, except costs of lcbor contributed by the Federal Government under VTPA, shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for the cost and expense of such improvement except as provided in Chapter 141, Session Laws of 1923 or acts amendatory thereto, and the ordinances of the City of Everett. Section 3: There is hereby established a local improvement district to be called Local Improvement District No.-5 3 o _, which district shall include the following described property, to-wit:
