, 4_ • 1 f J ORDINANCE NO. 7 3 j- AN ORDINANCE providing for the improvement of Federal Avenue from Edward Avenue to 40th Street, also Edward Avenue from Federal Avenue to Friday Avenue, by the construction of a sewer and its necessary appurtenances and all other work to make a complete improvement, creating an assessment dis- trict, creating a local improvement district fund therefor; providing for payment of said improvement to be made by special assessment on the property in said district under the mode of payment by bonds for materials used, fixed estimate and all other expenses, except cost of labor furnished by federal funds under PA plan of the Federal Governrm nt. WHEREAS, a majority petition of the property owners petitioning for said improvement has heretofore been filed with the City Council, and upon examination thereof the said Lity council has found the things set forth therein to be true; and W E RAS, the said petition has been referred to the Commissioner of rublic Works to be examined by the said Commissioner and the City Engineer, and the Commissioner of rublic Works has filed with the City Council all data and information as required by law; and WHEREAS, said Commissioner of Public i!orks has recommended to the City Council that the improvement petitioned for be made and it appearing to the City Council that the public health, convenience and necessity require that such improvement be made ; and WHEREAS, it further appears that such improvement should be made only in the event that federal funds may be secured from the WPA for payment of labor costs and the propert in the said district may be assessed a sum for the costs of all materials, fixed estimate and all other expense of every kind not provided for by the Federal Government under \TFA and that such improvement should only be commenced upon the assurance that the Federal Government under tI TPA will furnish certain labor costs in connection with said improvement. NOW, THEREFORE, THE CITY OF EVERETT I OES ORDAIN: Section 1. That Federal Avenue from Edward Avenue to 40th Street, also Edward Avenue from Federal Avenue to Friday Avenue be improved by the construction of a sewer and its necessary appurtenances and doing all the work in the entire district necessary to make a complete improvement in accordance with the plans and specifications prepared under the direction of the City Engineer, which plans and specifica- tions are hereby adopted and approved. Section 2. That the cost and expense of all materials required to make a complete improvement, the fixed estimate and all other expenses of every kind, except costs of labor contributed by the Federal Government under WPA shall be borne by and assessed against the property included in the assessment district herein created in accordance with law.
